Ukraine will accept 10 thousand illegal migrants according to readmission from EU

State Border Service (SBS) forecasts deportation of 10 thousand illegal migrants to Ukraine according to Agreement on Readmission in 2010. As to analysis implemented by SBS the number of accepted persons will comprise 8-10 thousand per year according to Agreement from the next year, 6 thousand out of which will be citizens of Ukraine, and up to 4 thousand – the citizens of the third countries. From January 1, 2010 the other part of Agreement on Readmission between Ukraine and EU comes into force according to which Ukraine will accept those people who arrived to EU countries from Ukraine and had violated the rules on entrance and stay in the countries of European Union. SBS stresses that an obligatory condition on acceptance of persons is presence of evidences about their stay on the territory of Ukraine.

Ethiopian was detained presenting himself to be the citizen of Great Britain

Illegal migrant from Ethiopia was detained in the check point “Mostyska – railway station” (Lviv). The passenger of the train “Kyiv-Wroclaw” presented not his passport for the check – it was one of the 18-year-old citizen of Great Britain. The photo in the document was similar to one of the bearer. The border guard manifested the substitution. The violator was taken off the train and was delivered to sub-division of State Border Service of Ukraine. The traveller confessed that he was 19-year-old citizen of Ethiopia and arrived to our country for studies on legal basis. However, in fact, he did not plan to become a student. The young boy intended to get to Great Britain where his brother lives. According to the words of detained refugee, he had bought this foreign passport at home land.

Transcarpathian border guards detained four violators of the border

As it was declared by the press-service of Western District Administration of State Border Service of Ukraine, the border guards detained border violators in Transcarpathia – a citizen of Afghanistan and 3 Ukrainians. The Afghani person was apprehended in the area of border service “Uzhgorod”. He tried to get to neighbouring Slovakia. The foreigner did not have any documents.

Tourist from Syria was apprehended at Ukrainian-Polish border

The workers of Department of Border Service in Lviv region apprehended a man who made his way illegally to Poland. Operative-searching group caught up the violator some meters before the border line. Detained person was citizen of Syria who 4 days ago arrived to Ukraine with tourist aim through the airport Boryspil. The foreigner indicated Kyiv as the place of his stay in the migration card.

In general, in the course of 11 months of 2009 year the workers of State Border Service detained 2263 illegal migrants who were intending to cross the border illegally. And almost 19 thousand potential illegal migrants were refused in entering Ukraine.

200 illegal migrants will be readmitted to Ukraine from EU countries in 2010

Ukraine expects up to 200 illegal migrants in 2010 according to the programme on readmission from EU countries. This data was announced by minister of Interior Affairs Vasyl Marmazov at the press-conference. According to his words, it is an official statistics. “These are migrants who have been detained by the bodies of Interior Affairs of Ukraine. I do not calculate those persons who are sent back from the territory of Ukraine directly at their cross of the state border”, – V. Marmazov stressed. Deputy Minister remarked that all detained illegal migrants are kept for the state costs “Keeping one illegal migrant from the state budget comprises €2-2.5 per day”, – the official said. Herewith, he confirmed that next year the flow of illegal migrants to Ukraine can be increased if the corresponding amendments will not be put into legislation. Such risks exist if in the nearest time the initiative of MIA to create the single migration body attached to MIA will not be supported”, – he announced adding that the most part of illegal migrants is observed at the eastern and northern borders of Ukraine.

According to this fact, Ukraine needs the creation of temporary accommodation centers for illegal migrants as for the present moment there are only two of them – in Volyn and Chernihiv regions.

“In 2010-2011 Ukraine has an intention to build 2-3 centre for keeping the foreigners and persons with no citizenship who have been deported from EU countries according to Agreement on Readmission”, – V. Marmazov added.

In an interview to Oksana Klymonchuk from UNIAN, Deputy Ministry of Internal Affairs Vasyl Marmazov spoke about the agreement on readmission between Ukraine and the EU which is to come into force from 1 January 2010.

Mr Marmazov stressed that the agreement, reached on 18 June 2007, has already been in force with regard to readmission of nationals of the signatories who have infringed legislation. What is new is the part regarding readmission of nationals of a third country or stateless persons.

“I would like to stress that the law enforcement agencies of EU countries will return nationals of a third country or stateless persons to Ukraine only after they provide evidence that the people in question did in fact reach an EU country from Ukraine”.

He goes on to say that the Ministry of Internal Affairs [MIA], State Border Guard Service, can agree or not agree the procedure for readmission, and that it will not therefore take place automatically.

The relevant EU officials will need to explain why the illegal migrant should be returned to Ukraine, and not their country of origin, if the EU has a readmission agreement with this country. If it does not, and Ukraine agrees to take the person, then the Ukrainian authorities have to take measures to identify the person and his or her nationality, as well as determining his or her fate.

“There are two temporary centres for illegal migrants which were built over the last 2 years, one in the Chernihiv region (oblast), the other in the Volyn region.

These centres were mainly financed by public funding, however also with the support of the EU and International Organization for Migration [IOM].

The two centres are designed for 373 people and at present are only 70% occupied.  The plan in general is to open 5-7 of such centres. Over the next two years, I think three will be built, this depending on the migration flow, as well as on the EU’s fulfilment of its commitments as per the agreement to help Ukraine in developing institutional capacity.

How much did the centres already built cost?

The one in the Volyn region, for example, cost around 36 million UAH.

The EU is planning to allocate a further 30 million EURO, of which 10 will be for the needs of the State Border Guard Service and 20 – the MIA. In our case, we will use the money on building centres.

Without documents

It does happen that illegal migrants themselves destroy their documents, but there are also often cases where those who illegally transport them take their documents away.  It can take up to a year to establish a person’s identity, he says. If the person applies for refugee status, then the procedure may drag on even longer. “If the person is willing, then procedure for voluntary return may be applied, in which case the MIA works closely with the IOM which helps illegal migrants return voluntarily to their country of origin.

Since 2002 there has been separate funding in the Budget for sending migrants returned from Europe home. In 2008-2009 3 million UAH was allocated, this being money to be managed by the MIA. Another million was allocated to the Border Guard Service.

These figures are clearly insufficient and we are therefore actively promoting the implementation of a programme of voluntary return, with funding from the IOM and other NGOs dealing with migration.

The Ukrainian authorities can also use money from the illegal migrant himself, a person supporting him or at the expensive of third countries.

Where do most illegal migrants come from?

The largest number of illegal migrants reach Ukraine from the Russian Federation, some from Moldova and Belarus.

Most often this is people from China, Vietnam, Pakistan, Afghanistan, Nigeria, Egypt, Somalia and other African countries”.  Mr Marmazov points out the EU recently concluded a readmission agreement with Pakistan, which means that even those Pakistani nationals who reach the EU from Ukraine will be returned to their country of origin.

“Clearly, if for various reasons it is impossible to identify a person for a long time, they’ll be held in the relevant centres permanently. In some cases they remain in our country. However this is a very small percentage of the total number of people held in centres for illegal migrants – 1-2 %. In some cases even with this category, there can be legal grounds for their continued presence in Ukraine – marriage, for example, or the birth of a child. With regard to children born on Ukrainian territory, the provisions in legislation are applied which confirm their rights according to birth.

“I try to be an optimist, analyze everything calmly. I don’t quite accept the fears expressed by the mass media. That indicates only lack of information”.

Asked if there was any benefit to Ukraine from the readmission agreement, Mr Marmazov stressed that one could not speak of readmission in isolation from relations with the outside world, and that Ukraine has to somehow achieve liberalization of the visa regime. He considers readmission to be one of the mechanisms for fighting illegal migration, and sees this as being a task for the law enforcement bodies since the phenomenon is often criminalized. “Readmission generates very serious commitments which is an even greater stimulus for us to fight it.

And at the end of the day it is an element of being civilized. It is an objective reality and I would therefore generally avoid judgments, “black” or “white”.”

4 Afghani illegal migrants were detained on their way to Slovakia

4 illegal migrants, citizens of Afghanistan were detained at Ukrainian-Slovakian border due to joint efforts of law enforcement agencies of two countries. The group of violators was detected by Chop Border Detachment in the area of the post “Velykyi Bereznyi”. Seeing the detail, migrants started to run away. Two of them were caught 50 m from border line by Ukrainian border guards. Other two guys were apprehended in a moment by the workers of Slovakian Border Police. Detained persons by Ukrainian border guards were dressed not according the season (- 10 0C). Wearing trainers and autumn sport jackets they directed their way to the mountains where the snow had already reached 20cm. The workers of State Border Service delivered runaways to the sub-division where they finally got warm. The detainees did not have any documents. They named themselves to be the citizens of Afghanistan who together with their country fellows in the search of better life conditions planned to get to Austria. According to their words, their relatives paid for this trip $ 12 thousand for each. At the present moment these people are under identification, their route is investigated, and also persons connected with organization of channel of illegal migration are looked for.

Trespasser detained in Transcarpathian named himself a citizen of USA

The workers of Mukachevo Border Detachment detained a man who illegal crossed the border from Hungary. At daybreak the trespasser was detected by the post of technical supervision with the help of the infrared imager in the area of border service “Luzhanka”, and 200 m before the border line he was caught up by the operative-investigation group. Detained person did not have any documents. According to his words – he is 26 years old, citizen of American State Utah working in Kyiv. He went with his friend to Hungary where he had lost his documents. That is why the man decided to come back to Ukraine passing by the check point “Beregshuran”. At Ukrainian side he had to be taken by his friends by car, but the border guards of State Border Service were quicker to do this. The day after a border-representing meeting took place in the check point “Luzhanka” in the course of which detained American was passed to Hungarian border guards.

Sailor from Azerbaijan intended to cross the border with forged documents

Azerbaijanian who presented himself like Georgian to the workers of State Border Service of Ukraine was detected in Odessa region. The member of the crew of Dutch vessel “Ers Varot” in Illichevsk sea port showed the border guards forged passport of the sailor, the citizen of Georgia. Among other signs of falsity there were glued photo printed on the colour printer on the ordinary office paper. After uncovering the sailor named himself to be 26-year-old citizen of Azerbaijan. He confessed that he bought a forged document in his country paying for it $ 2000.

Two Turkish citizens attempted to pass by the check point at Ukrainian – Polish border

Two illegal migrants were caught in Lviv region – the citizens of Turkey. The foreigners drove up by the taxi to the check point “Shegyni” which they decided to pass by. They were noticed 200 m before the state border and were stopped by local inspector of Border Service. As it was cleared out, a day before the foreigners quite legally arrived to Ukraine by plane through the airport “Boryspil” as if with tourist aim. Instead of tourists routes the travellers went to Lviv where they hired a taxi to the border. At present illegal migrants are delivered to border sub-division.
