The Söderköping Process – continuation of dialogue

On May 4-5, 2011 a thematic seminar took place in Kishinev, Moldova in the frames of The Söderköping Process.

The first deputy director of State Department of Citizenship, Immigration and Registration of Physical Persons Viktor Davydenko presented Ukraine in the action.

The strategic goal of The Söderköping Process is in assistance of border cooperation among new EU member states and candidate-countries on asylum, migration and borders management issues.

In the beginning of the year 2001 UNHCR and Swedish Migration Service carried out joint initiative aiming at dialogue assistance on problems of asylum and irregular migration among the countries which are along the eastern border of EU. Initiative received its name “The Söderköping Process” in honor of the city Söderköping in Sweden where the first meting took place. At that time the participators of the meeting were officials from Byelorussia, Lithuania, Poland and Ukraine as well as the representatives of Swedish government, UNHCR, European Commission and International Organization of Migration.

Since 2001 The Söderköping Process has widened and includes already 10 countries: Byelorussia, Hungary, Lithuania, Moldova, Romania, Slovakia, Ukraine and Estonia. EC, IOM, UNHCR and Swedish Migration Service provide the present process with support.

During the seminar hold on May 4-5, 2011 the last tendencies in integration of The Söderköping Process into Eastern Partnership were considered as well as results of the last meeting concerning Agreements on Readmission. There were also presentations of existing initiatives in the sphere of labor and season migration.

Police did not give an opportunity to Afghans to walk easily about Uzhgorod

At night policemen of Uzhgorod Police Local Department found three men of typical Asian appearance nearby the railway station. Certainly, these persons had no any documents permitting him to stay in Ukraine on legal basis. They presented themselves as citizens of Afghanistan. Illegal migrants were detained and passed over to Chop Border Detachment.

Law “About enlisting changes to some legislative acts of Ukraine on migration issues” came into force

On may 5, 2011 a law came into force “About enlisting changes to some legislative acts of Ukraine on migration issues”. The law signed up by the President foresees the creation of appropriate legal principles in order to strengthen the fight against illegal migration.

Note that Supreme Council (SC) of Ukraine passed a bill “About enlisting changes to some legislative acts of Ukraine on migration issues” with proposals of the President of Ukraine.

Document foresees formation of corresponding legal principles on strengthening the fight against illegal migration, improvement of management by migration processes, intensification of juridical responsibility for law breaking in this sphere, ensuring with conditions for realization of migrants’ rights and equal conditions of mutual trips of the citizens of Ukraine and other states, activization of bilateral contacts in all fields of international relations, intensification of legal responsibility of foreigners as well as citizens of Ukraine for the break of migration legislation.

A regulation was also input to the text of the law about non-beginning of administrative responsibility in case of non-arrival of the person to a certain place of education or employment if it happens on valid reasons.

Iranian man having forged passport and unknown person with somebody’s French passport were detained in Boryspil

Border guards of Kyiv BS detained a man of Negroid race. Detainee was trying to get on the plane “Kyiv-Rome” and presented not his passport of the citizen of France to be checked. The traveller refused to give any explanations to the law enforcement agents on this point. At the present moment his personality is under identification.

The same day 44-year-old citizen of Iran was apprehended in the airport. The foreigner arrived to Ukraine by the flight from Istanbul. Border guards detected in his documents a forged note on permanent residence in Ukraine. The violator explained that with the help of mediator found in the Internet he decided to prolong the term of stay in our country. Mediator made such a note in the document for 3800 UAH. Later on it was established to be false.

Four Georgians tried to cross the border on Slovakia

During May holidays the border guards of western borders stopped three attempts of illegal border cross by the citizens of Georgia. Two cases took place in Lviv region and one in Transcarpathia.

On May 2, 2011 one citizen of Georgia was apprehended by the group of reaction of BD “Krakovets” in Yavorivskyi district. Five more persons, also Georgians, were detained in the area of Shegeni. All foreigners had documents and they confirmed the fact of intention to cross illegally the border on Poland. At present moment detainees are waiting for the court decision.

On May 3Four more seekers of better life were detected by the border guards in Transcarpathia in the area of BS “Uzhgorod” of Chop Border Detachment. The citizens of Georgia were trying to cross the border on Slovakia but they were stopped by border detail. The further destiny of detainees will be decided by the court.

ACTION WEEK AGAINST RACISM 2011

European-wide Action Week Against Racism was held all over Europe from 14 to 27 March 2011 organized by the UNITED for Intercultural Action – pan-European network against nationalism, racism, fascism and in support of migrants and refugees.

Every year, around 21 March, on the occasion of the International Day for the Elimination of all Forms of Racial Discrimination, the UNITED Network (www.unitedagainstracism.org) coordinates the European-wide Action Week Against Racism and calls upon the international community to erase racism, discrimination and intolerance, bringing people together and enjoying diversity.

As mentioned in this year UNITED Network’s statement, to eliminate individual, societal and institutional racism and the injustice they cause, each of us needs to reflect on our attitudes and behaviour, be conscious to the prejudices we carry with us, understand how we learned these and find ways of unlearning them.

When trying to make sense of poverty, deprivation and lack of opportunity, we are urged by the media and by politicians to divide into smaller groups and point the finger at each other, which has developed a culture of blame. This not only deflects from the realities of economic policies and big business practices that drive inequality deep into our societies, it produces a toxic environment of mistrust, suspicion and hostility. We must unite to challenge these racist, populist myths and educate our communities, developing programmes, policies and activities that can change deeply held preconceptions.

Chernihiv Public Committee of Human Rights Protection (ChPCHRP) as a many-year member of the UNITED Network, also did not stay aside from this year action week against racism.

There were held a series of lectures for the policemen and officials of the Administration of the Ministry of Internal Affairs of Ukraine in Chernihiv Region on the theme “Prevention of xenophobia and racism in the activity of law enforcement machinery”. Alla Lepekha, director of the Chernihiv Women’s Human Rights Center and Tukhan Ediev, ChPCHRP’s program manager delivered lectures on historical origin of the terms “racism” and “xenophobia”, highlighted what is concept “hate speech”, cited last statistics on hate and racism crimes in Ukraine. The speakers emphasized that manifestations of intolerance and discrimination, unfortunately, are still widespread in our community. But, law machinery does not always adequately respond to these manifestations. Sometimes policemen also manifest racism and discrimination.

During the action week against racism, on the basis of the Rozsudiv Migrant Accommodation Center in Chernihiv Region of Ukraine, there were also held joint meetings with the detained migrants and Center’s personnel on the issues of respect for migrants’ right and prevention of intolerance and xenophobia from the part of the personnel.

Border support to migration management in Ukraine

On 16-17 March, 2011, in Kyiv, the official closure of the GUMIRA project and launch of the SIREADA project, funded by the European Union and implemented by the International Organization for Migration (IOM) Mission in Ukraine, took place.

The European Union has committed EUR 2,500,00 (UAH 27,574,234) for GUMIRA and EUR 2,377,205 (UAH 26,219,842) for SIREADA.

On 16 March, the IOM-organized event featured the final GUMIRA steering committee meeting, “Acknowledgement of the achievements, identification of the road ahead”.

On 17 March, the official launch of the SIREADA project assessed the results of GUMIRA, and presented the priorities in implementation of the new project.

The two-day event aimed to highlight the efforts undertaken within the GUMIRA project, and to introduce the main goals of SIREADA.

Distinguished invitees included representatives from the following: Ministry of Internal Affairs of Ukraine, State Border Guard Service of Ukraine, Ministry of Foreign Affairs of Ukraine, Delegation of the European Union to Ukraine, United Nations High Commissioner for Refugees, government agencies of Moldova and the Russian Federation responsible for migration management, and international and national civil society actors.

A group of illegal migrants from Afghanistan was apprehended by the border guards in Volyn region and a stolen car was found

Detail of Border Department “Korytnycya” of Lviv Detachment detected six unknown persons 1,5 km before the border on Poland in the suburb of the village in Volyn region. Seeing the law enforcement agents the refugees started to run. One of them was detained by the border guards at once. In an hour the group of three persons was found in the forest. Detainees were citizens of Afghanistan. At the present moment their friends are still in the search who are probably illegal migrants or guides. An interpreter is expected for the work with the foreigners. During the searches of the illegal migrants border guards found a car (of Ukrainian registration) without the driver in the forest. The officers established the personality of the man who could drive the vehicle. According to his words, his car was stolen the day before and he did not state to police about this incident as he was in a hurry. Now the circumstances of the infringement and participators to its organization are established.

Sheepdog Bessy helped detain 4 illegal migrants from Georgia

4 illegal migrants – citizens of Georgia were detained in Transcarpathian region 350 m before the Ukrainian-Slovakian border. Detail of Department “Uzhgorod” detected the tracks of the group of persons during the patrolling. Searching dog Bessy helped the law enforcement agents to find and stop the trespassers. Detained men were citizens of Georgia. As it was established later, three illegal migrants arrived to Ukraine some days before this incident through the airport “Boryspil”. One more Georgian has lived in the town of Makiivka, Donetsk region on the legal basis since 2008.

About assignment of integral property complexes of Temporary Accommodation Centers for foreigners into the field of management of State Migration Service

Government approved an order dated from April 27, 2011 about assignment of integral property complexes of TACs for the foreigners and persons without citizenship who stay in Ukraine illegally into the field of management of SMS. It said in the document about transference of the centers located in the village of Zhuravychi, Volyn region and v. Rozsudiv, Chernihiv region.

In another order passed at the meeting f Cabinet of Ministers of Ukraine it is said about attributing of property complexes to place temporarily refugees located in the towns of Mukachevo ad Perechyn (Transcarpathian region), t. Yagotyn (Kyiv region) and in the city of Odessa also to a field of management of State Migration Service.
