Illegal migration was discussed in Transcarpathia

Meeting was dedicated to determination of order of readmission between newly-created Police Department of Migration Control and other law enforcement agencies of the region on issues of counteraction of illegal migration.

The principal tasks entrusted to Police Subdivisions of Migration Control are to realize control on keeping legislation in the sphere of migration as well as counteraction to illegal migration, apply of foreseen by law measures on process ensuring in case about administrative infringement; preparation of proposals on shortening of stay period of foreigners ad stateless persons in Ukraine, their forced return, compulsory expel and also ban on entrance to Ukraine, etc.

According to the words of deputy head of SSU in the region, Vasyl Bukovchanyk, for the present moment newly created department realizes a complex of actions directed upon the supply with valuable functioning of the service. At the same time, during the practical realization of imposed tasks in the sphere of migration legislation, a series of problem questions have arisen. The ways of their solution were discussed in the course of the meeting. Thus, the chief of Head Department of SMS of Ukraine in the region, Igor Mykhailyshyn has marked that there is an urgent necessity in established mechanism of interaction between the subdivisions in preparation of materials concerning foreign citizens as well as illegal migrants, who do not have any grounds for further stay on the territory of Ukraine.

Namely on this purpose, the board of Migration Service of the region made a decision on transference to police realization of migration control of present information as to foreign citizens, who were prolonged the term of their stay, issuance of certificate for employment, persons receiving abolishment of such permissions and other categories of the foreigners including those who commence petition on refugee status granting. Nowadays, there are more than 2 000 foreign citizens in database, who stay on the territory of the region.

In the course of the working meeting, the problems moments were discussed such as holding of illegal migrants for the period necessary to prepare documents for consideration of administrative claim in the court. There is lack of qualified translators, who are necessary for the work with detainees, their identification. According to the results of the session, a series of decisions were made directed upon the effective cooperation of Police Department of Migration Control with law enforcement agents and controlling bodies in the region on the issues of state policy realization in the sphere of counteraction to illegal migration.

Ukraine is accused in violation of the rights of the refugees

Supreme representative of EU on issues of Foreign Policy and Security Policy, Katrin Eshton and Euro commissar on issues of expansion and European Neighborhood Policy, Stefan Fule – EU “is deeply anxious about news that a man from Russia (Ingush Republic) being recognized as a refugee in accordance with International rights was extradited from Ukraine on August 15”.

It was said about in a common statement of press-secretaries of supreme representatives of European Union.

“They entirely support conclusion of UNO Refugee Agency that this case testifies about violation of obligations to keep the principle of inadmissibility of compulsory return” – it is said in the statement. In view of this, Eshton and Fule mark that plan of action on liberalization of visa regimen in the frames of visa dialogue between EU and Ukraine includes a series of Kyiv’s obligations concerning legislation adoption on asylum in accordance with international ad European standards as well as human rights protection seeking asylum and refugees.

“The fact is worth to be regretted that in this case Ukraine apparently does not respect these obligations in spite of repeated and clear requests, which were expressed during the last weeks by UNO Refugee Agency and EU” – it is mentioned in the statement.

Could illegal migrants tell about the tunnel in Slemence?

As it is reported by the site of Ministry of Interior of Slovakian republic, on August 10 police patrol detained 2 foreign citizens at 5 p.m. not far from the village Slemence nearby the border, who were illegal migrants from Guinea.

Detainees could not prove their nationality as they did not have documents. Soon they were delivered to Border Police Department in Slemence. Health state of the foreigners was good. Migrants asked asylum in Slovakian Republic. Later they were transferred to Police Subdivision in Humenne.  It is not excluded that just this last case has  became the reason of disclosure of underground tunnel between Ukraine and Slovakia.

Three citizens of Georgia were stopped nearby Ukrainian-Polish border

Border guards of Mostytskyi Detachment apprehended a group of illegal migrants from Georgia nearby the border. Detail of BS “Shegeni” received information about appearance of unfamiliar persons near the border and in some minutes three men were detected and apprehended, who were moving quickly in the direction of Ukrainian-Polish border. Violators trying illegally to cross the border line were citizens of Georgia. During the realization of filtration measures it was established that all of them intended to get to Poland and then to Sweden with the aim to find job.

Detainees were delivered to department of Border Service in order to establish circumstance of the infringement and draw up administrative and procedural documents.

Illegal migrants were detained in Transcarpathia

Border guards of Chop Detachment were detaining illegal migrants from Georgia and Somalia during some days.

Receiving operative information about appearance of unknown persons nearby the border, law enforcement agents detained “travellers”. Citizen of Georgia was apprehended in the area of BS “Novoselytsya”, two citizens of Somalia were stopped by border detail “Velykyi Bereznyi”, one more citizen of Somalia and two citizens of Eritrea were detected by the military men of BS “Stuzhytsya”. During the realization of filtration measures it was established that all detainees intended to cross illegally the state border of Ukraine to Slovakian Republic.

Besides, border guards of BS “Velykyi Bereznyi” detained six more citizens of Somalia. Three men and three women also wanted to get over the border.

All detainees were delivered to departments of Border Service in order to establish the circumstances of infringement and to draw up administrative and procedural document.

828 refugees applied for asylum since the beginning of the year in Ukraine

There are 2453 officially recognized refugees from 47 countries of the world residing on the territory of Ukraine. Only for six months of 2012, 828 foreigners applied to State Migration Service with application on their recognition as refugees or persons in need of protection. During the last year, from the moment Law of Ukraine “About refugees and persons who need subsidiary or temporary protection” came into force, for the first time 37 foreigners were recognized as such in need of subsidiary protection.

In the frames of international project “Regional programme on protection of refugees – Phase-II” European Union has allotted € 1,5 million for aid to Ukraine, Moldova and Belarus. Out of them € 0,5 million was given to solve problems with refugees in Ukraine. Financing of the programme will last till December 2013.

Programme foresees financing of nationwide network of lawyers, who will follow up how are the rights of refugees and asylum seekers are kept, the reconstruction of THFs, the work of translators is ensured, language courses for asylum seekers and support of programme on migrants’ employment. Besides, it is assistance in certification of diplomas and grants (up to 25 000 UAH) for their starting own business in Ukraine.

At the support of UHNCR, on August 9, 2012 a meeting of National Managing Committee of the project in Ukraine was hold in Lviv at the participation of UNHCR specialists, Representation of European Union in Ukraine, International Organization of Migration  (IOM) as well as representatives of State Migration Service of Ukraine, Highest Administrative Court, SSU, Commissioner on issues of realization of national preventing mechanism. The representatives of public human rights organizations from different regions of Ukraine participated in the meeting.

Coordination of actions of governmental and public structures working with refugees and asylum seekers in Ukraine became the main subject of discussion.

According to the words of Carol Shusha, manager of sector on law supremacy and law exercise of Representation of EU in Ukraine, European Union invests sufficient costs into integration programmes. However, these investments are too little. The important readiness of the governments of the countries is to accept these investments. European experts point out a progress in apprehension of importance of integration processes by Ukrainian authoritative institutions, but they also admit the existence of the problems left and need to be solved.

Turk will be judged for smuggling illegal migrants to Slovakia

In Transcarpathia SSU completed pre-trial inquest in criminal case as to the citizen of Turkey, who intended to smuggle repeatedly illegal migrants through the state border. 

On August 8, inspectors of Administration of SSU in Transcarpathian region directed criminal case to the court commenced against the citizen of Turkey, who intended to smuggle four illegal migrants through Ukrainian-Slovakian state border.

As it was established, in 2009 foreigners was already sentenced to 5 years of imprisonment for illegal transportation of persons through the state border of Ukraine and falsification of documents. However, by the court decision he was released pre-term and expelled from Ukraine.

In June of the current year, he turned to organize illegal transportation of two country fellows and two Syrians by transit through Ukraine to EU. As malefactor was forbidden to enter Ukraine, he used forged passport on different name.

The organizer with the group of illegal migrants got to Ukraine through Odessa and Lviv by different means of transport. In order to smuggle illegal migrants beyond the check point at Ukrainian-Slovakian state border, the malefactor took a taxi.

Law enforcement agents detained the violator at the road nearby the settlements Tarnivtsi-Kontsovo, Uzhgorod district, which is 1,5 km before the border of Ukraine on Slovakian Republic.

Concerning the citizen of Turkey, SSU inspectors in Transcarpathian region commenced a criminal case according to Part 3 Article 332 (illegal transportation of persons through the state border of Ukraine) and Part 4 Article 358 (falsification of documents, seals, stamps and blanks, realization or use of forged documents, seals, stamps) of Crime Code of Ukraine. The criminal is threatened wit 7 to 9 years of imprisonment.

Seminar-conference: Apply of legislation about refugees and persons who need subsidiary or temporary protection of SMS of Ukraine in common with Administration of Police of Migration MOI of Ukraine

On August 9, 2012 seminar-conference has started its work in Odessa. The subject of the events is apply of legislation about refugees and persons who need subsidiary or temporary protection of SMS of Ukraine in common with Administration of Police of Migration MOI of Ukraine 

Conference was opened by the chief of State Migration Service of Ukraine M.M.Kovalchuk. The participators of the conference were the first deputy head of SMSU V.V.Sheibut, chief of Administration of Police of Migration Control of MOI of Ukraine I.I. Bashta, director of Refugee and Foreigner Department of SMSU N.M. Naumenko, the worker of representation of UNHCR in Ukraine, Belarus and Moldova – D.Plechko, managing staff of APMC MOIU, chiefs of Departments on Migration Control HA MOIU, chiefs of territorial subdivisions of Migration Control of HA MOIU, chiefs of territorial subdivisions of HA MOIU.

Syrians with double documents were detained in airport Boryspil

During the check-in of the passengers in the airport Boryspil , who made their way to Stockholm, border guards detained to men. They presented forged documents for control. These documents belonged to citizens of Turkey. Border guards established that photos were replaced in the documents. However, soon, law enforcement agents, found another pack of documents in travellers’ things – these were Turkish service passports. As it was explained by 33 ad 48-year-old detainees, they were citizens of Syria. With the help of forged documents, they planned to get to Sweden, where their relatives lived.

Pseudo-Turks were detected in the airport “Boryspil”

Visa-free order of entry between Ukraine and Turkey has just come into force. 25 and 21-year-old citizens of Syria tried to take opportunity of this. Thus, in the airport Boryspil during the check in of the passengers arriving from Istanbul, border guards detected two young men, who presented forged passport documents of the citizens of Turkey. Border guards established that photos of the owners were replaced in the documents. Passengers explained that they were Syrians and proving it they gave their own passports. At the present moment “travellers” are sent by return flight to the country of take-off.
