Four Afghans with one-year-old girl were apprehended nearby the border on Slovakia

In the frames of conducted actions aimed at counteraction to illegal migration, border guards of Chop Detachment apprehended a group of illegal migrants that traveled to the countries of European Union. In the evening, border guards of BS “Palad Komarivtsi” securing the area of Ukrainian-Slovakian border detected some persons with the help of mobile thermal imager, who were moving in the direction of Slovakia. In some minutes, unfamiliar persons were detained in the distance of 100 m before the border. There were four “tourists” – two men, one woman and a girl of almost 1 year old. As it happens in such cases, detainees did not have any documents and informed the border guards that they were the citizens of Afghanistan. The goal of their trip was European Union. Detainees were delivered to subdivision in order to establish the circumstances of the infringement and process administrative and procedural documents. Decision on responsibility before the law and further destiny of the violators will be decide by the court.

State Border Guard Service summed up its activity for 9 months

The board of Administration of State Border Guards Service of Ukraine conducted a meeting during which the operative and service work of the department was summed up for the period of 9 months.

In general, in the course of 9 months the staff of SBGS registered almost 77 million persons and 16,5 million vehicles. Altogether, there were detected 283 forged documents, 109 another’s n ones and 11,5 thousand  invalid documents. Besides, there were detained 1317 illegal migrants, out of which 678 for illegal cross of the border and 613 for violation of the rules on stay in the country. The check points rejected 3428 potential illegal migrants in entering the country.

Two Iranians paid $16 000 for false passports

In the airport “Boryspil” border guards of separate check point “Kyiv” during the check of the documents detected two false documents in passengers travelling by transit from Tbilisi to Frankfurt.  It was established that the pages with constituent data of the bearers were changed in the passports of the citizens of Spain presented for control. As the travelers explained, in reality they were Iranians and they addressed to Embassy of Spain several times aiming at getting visas, but they received rejects. Thus, they started to Turkey, where they bought forgeries for $ 16 000 and made their way to Georgia, then to Ukraine having the aim to get to Germany.

At the present moment, documents were confiscated and the men were returned back by a return flight to the country of departure.

Citizen of Cote d’Ivoire with forgery was detained in “Boryspil”

In the airport “Boryspil” during the check in of the passengers travelling to Brussels, border guards of separate check point “Kyiv” detained 35-year-old woman. The traveler presented for control the passport of the citizen of Cote d’Ivoire, in which the photo and constituent data of the bearer were changed. As the passenger informed she arrived from Republic of the Ivory Coast. She also explained that she had certificate on residence in Ukraine, and forgery she received by post from her relatives as the term of her document completed. The violator was handed to MOI representatives.

SSU stopped the smuggling channel to Slovakia

According to the materials of SSU in Transcarpathian oblast, the organizer of the criminal grouping and his assistant were convicted in smuggling illegal migrants through the state border.

Sentence of Uzhgorod Municipal Court came into force concerning 41-year-old resident of Perechyn region and his 37-year-old countryman, who transported citizens of Afghanistan through Ukrainian-Slovakian border in the composition of criminal group.

In October 2012, this citizen being tried before for illegal transportation of persons through the state border of Ukrainian, he agreed to take a group of illegal migrants – 5 citizens of Afghanistan to Slovakia beyond the check points for $5000. In order to realize his intentions, he drew in two countrymen as well as the inhabitant of Uzhgorod region and resident of Lviv oblast. One of the accomplices met the group of illegal migrants in the village of Nyznie Vorota, Volovets region and took them secretly by the car to bathhouse that belonged to the parents of the organizer. In some days the malefactors, among whom there was a deputy of one of Municipal Councils, “provided” with smuggling of 5 Afghans though the state border of Ukraine to Slovakia.

On October 26, the organizer gave instructions to the members of the criminal group to meet three more citizens of Afghanistan at the railway station “Svalyava”, who arrived there by the train “Moscow-Uzhgorod”.

One day the organizer had to deliver illegal migrants to before agreed place and hand migrants to their accomplices for illegal transportation of Afghanis to Slovakia.

On October 30, 2012 a car driven by the organizer with illegal migrants was detained by the officers of SSU in Transcarpathian region.

Later on, law enforcement agents apprehended other persons involved in unlawful activity. Uzhgorod Municipal Court adjudged guilty the organizer of the criminal activity and his 37-year-old accomplice according to Article 332 of Crime Code of Ukraine (illegal transportation of persons through the state border of Ukraine) and sentenced them to 5 year of imprisonment with probation period of 2 years.

Criminal cases as to other 3 members of this criminal group are now considered by the court.

Transcarpathian border guards apprehended two groups of illegal migrants

Border guards of Chop Detachment detained two groups of happiness seekers, who intended to get to the territory of EU by illegal way.

In the first case, due to assumed measures of the staff of Detachment on the territory of Perechyn region a group of persons was detained moving by car towards Ukrainian-Slovakian border. Out of six persons being in the car only the driver, the citizen of Syria, had identifying document permitted permanent residence in Ukraine. The other five persons, who were the country fellow of the driver among whom there was a minor boy, could not represent any documents to law enforcement agents. According to fact of detected signs of crime commitment, foreseen by Article 332 of CC of Ukraine, SSU in Transcarpathian oblast was informed on that point.

The other daredevils getting in the direction of Slovakia through the mountains were apprehended by the detail of BS “Velykyi Bereznyi”, who were a family with a child of one year old. The man and woman having no any documents reported to law enforcement agents that they were the spouses, migrants from Afghanistan. It was also learned according to the words of the detainees that the father of one of the spouse paid in Afghanistan to unfamiliar persons about $ 10 000 for their trip to Europe.

All violators were delivered to border subdivision for establishing the circumstances of the infringement and processing administrative and procedural documents. Decision on responsibility before the law and their further destiny will be made by the court.

Temporary Holding Centre in Mukachevo is overcrowded with children

In the frames of visiting meeting of Committee of Supreme Council of Ukraine on problems of human rights, national minorities and international relations, representative of Commissioner of Supreme Council of Ukraine on observance of children rights, Oksana Filipishyna visited TAC for refugee in Mukachevo.

 

Here, she acquainted with the living conditions of children asylum-seekers. In a result of communication with children it is established that they do not have appropriate access to educational services, they are not provided with the translators, work on their socialization and integration into society is not implemented.

Oksana Filipishyna has reported about these and other problems issues at the meeting of Parliament Committee focusing attention of the present on the fact that the number of minor asylum-seekers with accompaniment of adult who whish to get refugee status or status of a person in need of subsidiary or temporary protection increases within each year in Ukraine, however status granting and integration into Ukrainian society is realized in a very slow way.

“The number of children receiving the corresponding status is too low. In majority cases, the children receive reject in granting the corresponding status: in 2010 – 69,4% (out of the number of applications on which corresponding decision was made), in 2011 – 55,6% , in  ​​2012 – 58,1%.

In addition, the procedure on status granting to children is extremely enduring: in the end of 2010 – 23 children out of 59 applied ones were in the procedure of status granting, in 2011 – 13 out of 22, in 2012 – 30 of 73. However, in accordance with the legislation on consideration of application about recognition as a refugee or person in need of subsidiary or temporary protection must be carried out within the time limit of not more than three months since the day of made decision on document processing.

It is inadmissible when consideration of applications on granting the corresponding status is delayed because State Migration Service sends back materials of the case to territorial subdivision for rework. Only after intervention of Commissioner of Supreme Council of Ukraine on human rights of State Migration Service of Ukraine a decision was made on granting the status of a person in need of subsidiary protection to two children from Afghanistan, whose applications had been considering more than 7 months. At the moment there are no instructions as to authorities of legal representative appointed to a child for representing her interests in the bodies of governmental power, establishments and organizations.

In practice, the authorities of legal representative for a child is limited by writing application on behalf of the child about his intention to get refugee status or status of a person in need of subsidiary protection. This kind of uncertainty can lead to child’s threat to find himself in dangerous conditions for his life and health.

Municipal bodies off executive power do not carry out control for living conditions of this category of children and their accompaniment. In most cases, children live in the families of friends, with whom they made friendship, live in conditions unsuitable for residence, work at the markets, miss Ukrainian language courses, etc. such children are accompanied just by organizations like UNHCR, connection with them is often lost.

So far, procedure of  age determination of children separated from the families arriving to the territory of Ukraine has not yet been approved, which make difficulties in placing the children.

As a rule, these are children in the age of 16-17 years old without documents, when detecting them they present about themselves invalid data making identification impossible. In consequence, order of forensic examination is applied in a crime procedure to determine the age of a child that arrived to the territory of Ukraine without adult’s accompaniment.

There is a problem of arrangement of children separated from the families, who came to Ukraine without accompaniment of adults. Placements of children to orphans and shelters for children do not solve the problems of integration of children-asylum-seekers into Ukrainian society. In the present context it is necessary to take immediate measures on speeding up the opening of Acceptance and Stay Centre for children arriving to the territory of Ukraine without adult’s accompaniment and children-refugees on the grounds of TAC in Yagotyn, Kiev oblast, which has been in the process of construction in the course of 7 years providing with living conditions for their residence and socialization”, – Representative of Commissioner marked.

Border violator exploded himself and two border guards at check point “Bachivsk”

On October 4, at 00.15 minibus “Mercedes” of Moldavian registration arrived with 4 passengers – citizens of Moldova – to international check point for automobile connection “Bachivsk” (Symy oblast, Ukrainian-Russian are of the border) at the entrance to Ukraine from Russia. In the course of the examination of the vehicle, one more person was detected hiding in the passenger compartment due to the watchfulness of border control inspector. It was established de bene esse that in the same way he freely crossed Russian check point “Troebortne”.

The detainee was taken to the passport control cab for additional check, where he presented the passport of the Russian citizen to the border guard. During the check of the document it was established that it did not belong to him.

At 00.44 while his interviewing, detained citizen carried out the explosion of himself by unknown explosive device. He died and two border guards were injured: the senior warrant officer and sergeant major.

The shift of border details in the check point was implemented in accordance with the present legislation of Ukraine and in the frames of competence of State Border Service of Ukraine.

Wounded staff of SBSU was sent to regional hospital in the town of Glukhiv by ambulance at 1.15. Their health state is grave. Reanimation car with experienced doctors was directed from Central Clinical Hospital of SBSU. The families of wounded officers are rendered various assistance.

Joint inquest-operative commission of Public Prosecutor’s Office, MOI, SSU and SBSU works at the place of the accident. Ukrainian-Russian border area is transferred into a regimen of intense guard. Russian side is informed.

Transcarpathian deputies have analyzed practical aspects of legislation on refugees

On October 1-2, two-day meeting of Committee of Supreme Council of Ukraine on problems of human rights, national minorities and international relations was hold in Transcarpathia. The subject of discussion was issues of the state of right promotion of national minorities in Transcarpathia and practice of apply of legislation of Ukraine about refugees and persons in need of subsidiary or temporary protection in western border region. The participants of the meeting were the head assistant of Supreme Council of Ukraine, Ruslan Koshulynskyi, national deputies of Ukraine – members of the Committee, diplomats, representatives of bodies of executive power, local self-government, representatives of national and cultural communities. There was also the chief of work organization of TACs for refugees and other categories of migrants of SMS of Ukraine and chief of Chief Department of SMS of Ukraine in Transcarpathian oblast, Igor Mykhailyshyn. Speech of welcome to the participants of the event was presented by the chief of Regional State Administration Oleksandr Ledyda and the chief of Regional Council Ivan Baloha. It was also marked that the representatives of more than hundred nationalities had lived in peace and harmony in the oblast in the course of many centuries, so Transcarpathia had a sufficient experience in realization of state policy in the field of international relations, apply of legislation of Ukraine about refugees and persons in need of subsidiary or temporary protection. The same thing was mentioned by the head of the Committee, Valeriy Patskan motivating decision on conducting the visiting meeting namely in Transcarpathia. The members of Committee  of Supreme Council of Ukraine on problems of human rights, national minorities and international relations visited also Temporary Holding Centre for refugees in the oblast. National deputies became acquainted with infrastructure of the establishment, communicated with its residents. Asylum seekers shared their problems. The problem on official workplace search is one of the most important constituents in the process of integration. For Syrian Mustafa Diara, studying well at school, the actual problem is to receive higher education. The chief of the Committee promised the boy to assist in realization of his striving into reality. In conclusion, Valeriy Patskan thanked the chief of Migration Service of the oblast, Igor Mykhailyshyn for support in organization of visiting meeting of profile Committee of Supreme Council of Ukraine.

Three illegal migrants from Armenia and Moldova were apprehended at the border in Transcarpathia

Three illegal migrants were apprehended in Transcarpathia by the border guards of BS “Tysa” of Chop Detachment.

Receiving operative information about possible stay of unknown persons in the suburb of the town of Chop, law enforcement agents checked the present direction. Two women and a man without documents were detained in the evening. According to the words of the detainees, citizens of Moldova, the women intended to get to Italy. Armenian reported that he wished to get to Switzerland.

Then, detainees were delivered to border subdivision in order to establish the circumstances of the infringement and draw up documents on administrative procedure.
