December 18 – Internal Migrant Day

International Migrant Day is celebrated by proposal of General Assembly of UNO (Resolution № A/RES55/93) every year on December 18 staring since 2000. In this day in 1990, General Assembly of UNO passed International Convention about Rights Protection of all working-migrants and members of their families.

In resolution of General Assembly it was proposed to all UNO member-states, governmental and non-governmental organizations to celebrate International Migrant Day on the basis of the activity on dissemination of information about human rights and principle freedoms of migrants, experience exchange and elaboration of measures as to security of their protection.

In the course of the last years, Ukraine has made a series of important steps in bringing national legislation in the sphere of migration in conformity to corresponding world standards. In 2011, Supreme Council of Ukraine passed Law of Ukraine “About refugees and persons in need of temporary or subsidiary protection”. This law introduced principally new form of protection – subsidiary protection.

In 2012, a number of changes has been made to the Laws of Ukraine “About legal status of foreigners and stateless persons” and “About freedom of movement and free choice of place of residence in Ukraine” due to which the grounds were regulated for foreigners and stateless persons’ stay in Ukraine and procedures of interior state migration were liberalized as well.

Ukrainian-Turkish consultations on migration issues were hold in Turkey

On December 11-16, 2012 Ukrainian-Turkish consultations on migration issues were conducted in the city of Ankara and Istanbul (Turkish Republic). Ukraine was presented by the chief of SMS Kovalchuk M – the chief of delegation, director of  DUSRR Dekhtyarenko S, adviser of chief of SMS Sokolyuk M., and representatives of Department of Migration Control of MOI.

In the course of the consultations the following subjects were discussed – state and perspectives of development of bilateral Ukrainian-Turkish relations in law enforcing spheres, migration issues as well as ways of information exchange between departments of both countries aiming at realization of operative measures in the fights against illegal migration.

Informative-familiarization visits to structural and territorial subdivisions of MOI of Turkey and to subdivisions on problems of work with migrants were carried out in the frames of the visit.

Pseudo-French was arrested at Ukrainian-Moldavian border

Yesterday, a car arrived to the check point “Kuchurgan”, Odessa oblast, driven by the citizen of Moldova. There was a passenger of African appearance. For the passport control he presented a document for travelling abroad of the citizen of France. However, in the course of detailed identification, regardless of boisterous explanations of the citizen that document belonged to him, border guards of Belgorod-Dnistrovskyi Detachment established that photo in the passport belonged to other person. Because of non-observance by the foreigner of rules on border cross and the absence of real passport document he was rejected in entrance to the country and was returned in a return direction.

In general, during 11 months of 2012, the officers of State Border Service of Ukraine did not admitted to Ukraine almost 4,4 thousand illegal migrants. Besides, 15,7 thousand passports were detected, the minority of which were invalid, forged or belonged to other persons.

Problems of in-depth cooperation of SMS and UNHCR were discussed in Geneva

On December 10-14, the first chief deputy of SMS Victor Sheibut and director of Department on Issues of Refugees and Foreigners Naumenko N.M. participated in the 5th Dialogue of UNHCR on the subject “Faith and Protection” that took place in Geneva (Swiss Confederation).

The principal goal of the event was to look for the practical ways of cooperation at the local and national levels in order to improve the protection and aid to refugees, displaced persons and stateless persons for stamping out discrimination, xenophobia and peace strengthening.

During the visit, delegation of State Migration Service of Ukraine took part in the Fifth Dialogue of Supreme Commissar of UN Refugee Agency on the problems of protection, in plenary meeting and discussion of the subjects reviewed, in the work of the round table on the subject “Cooperation improvement”. In the course of the working meetings, discussion was conducted on the issues on activation of cooperation of SMS and UNHCR, allotment of subsidiary financing for UNHCR for realization of projects in Ukraine.

Trespassers from Afghanistan and Russia were apprehended in Transcarpathia

Border guards of BS “Uzhgorod” of Chop Border Detachment heard some voices of people nearby the border at night. Reaction group with service dog arrived at once to supposed place of location of uninvited guests. In some minutes law enforcement agents detained six citizens of Afghanistan 1200 m before the state border line. There were four men and two children without documents among detainees. All of them were delivered to Temporary Holding Facility, where “seekers” of better destiny were examined by a doctor and fed with warm dinner. After court decision, all persons were passed to State Migration Service of Ukraine in Transcarpathian region.

Two more citizens of Afghanistan without documents intending to get to Slovakia illegally were apprehended by the border guards of BS”Knyagynya” 100 m before the state border.

Two illegal migrants from Ossetia were found in the bus “Rakhov-Uzhgorod”. Border guards of BS “Delovoe” of Mukachevo Detachment apprehended passengers without documents in the distance of 5 km before the borderline while checking documents of the passengers. According to their words, they were citizens of Russian Federation (Ossetia).

Border guards detained a citizen o Turkey and Congo with forged documents

In the check point “Chop-passenger station” border guards of Chop Detachment during the registration of the trains “Moscow-Bratislava” and Moscow-Budapest” detected passport documents of Republic of Bulgaria and Kingdom of Belgium in 2 citizens of Turkey and woman from Congo that contained the signs of partial forgery or did not belong to their bearers. In accordance with Article 358 of Criminal Code of Ukraine and 208 of Criminal-Procedural Code, workers of MOI were informed on this point. The citizens were called to administrative responsibility as to Article 202 Part 2, Article 204-1 of Code of Ukraine on Administrative Infringement for the attempt to cross the state border illegally.

Legal and social protection of children seeking asylum and children-refugees was discussed in Kyiv

On December 4, 2012 a working meeting took place on the issue of submission of the project by Danish Council “Legal and social protection of children seeking asylum and children-refugees in Ukraine, Belarus and Moldova” to corresponding governmental services.

The participants of the meeting were representatives of Ministry of Social Policy, Ministry of Education and Science, Youth and Sports of Ukraine, Ministry of Health Care, UNHCR, Supreme Council Commissioner on human rights, State Migration Service.

Project on Procedure of age determination of a child separated from the family is presented

On November 30, 2012 on requirements implementation to the Law of Ukraine “About refugees and persons in need of temporary or subsidiary protection” a full-scale meeting of Inter-agency working group was hold with attraction of international and national experts at which project on procedure of age determination of a child separated from the family was presented. Danish Council together with Ministry of Health Care of Ukraine worked out the project.

According to the results of a proposed project, a necessity was marked to process this document by interested CBEP (Central Bodies of Executive Power). The chief of Department of Social Integration and Interaction with Non-governmental Organizations, Babiychuk A.V. took part in the meeting on the part of State Migration Service of Ukraine.

Ukraine and Austria will work together on the problems of prevention and counteraction to illegal migration

Signing of implementation protocol between Cabinet of Ministers of Ukraine and Austrian Federal Government about realization of Agreement between Ukraine and European Copartnership on readmission of persons took place in Ministry of Interior of Ukraine.

On the part of Ukraine Protocol was signed up by the Ministry of Interior Vitaliy Zaharchenko, on the part of Austria – Ambassador Extraordinary and Plenipotentiary of Republic of Austria in Ukraine, Wolf Ditrih Haim.

The chief of State Migration Service of Ukraine Kovalchuk M. took part in the procedure of signing.

The signing of the Protocol will give an opportunity to create conditions necessary for coordination of cooperation of competent bodies of both governments in the problems of prevention and counteraction to illegal migration, inquiry implementation and realization of persons’ readmission.

German was detained helping his friend to get to Poland

Border detail of BS “Krakivets” of Mostytsk Detachment apprehended two men nearby the state border. One of the detainees had passport for travelling abroad of the citizen of Germany, another man had document for travelling abroad of a native of Russian federation.

In the course of circumstances establishment it became known that violators arrived to Ukraine on legal basis. However, 32-year-old German, native of Russia, tried to help his friend to cross the border illegally. As if in the search of better life, Russian man wanted to find a job in Germany. Thus, friends decided to get illegally to Poland and then they had to be met and sent to Germany.

These citizens were called to administrative responsibility for attempt to cross the state border of Ukraine illegally. Their further destiny will be decided by the court. Besides, materials on the infringement are passed over to investigation body of SSU in Lviv region, where legal decision will be made in accordance with Part 3 Article 332 of Crime Code of Ukraine.
