Four illegal migrants from Sri Lanka were detained in Transcarpathia

The group of illegal migrants was detained in Transcarpathia by the border guards of BS “Uzhgorod” of Chop detachment. Law enforcement agents were informed about the appearance of unfamiliar persons nearby the state border by Slovak colleagues, who checked the attached area to border of Slovakian territory.  Verifying information, border detail detained the violators almost 5 meters before the border. The “travelers” – three men and a woman, confessed that they were the citizens of Sri Lanka, however they could not prove it by documents.  All detainees were delivered to department of BS “Uzhgorod” for clarification of the circumstances and issue of administrative and procedural documents.

Besides, border guards of Chop Detachment apprehended the same “happiness seekers” in the area of BS “Guta”. Two citizens of Georgia of 1973 and 1988 DOB intended to cross Ukrainian-Slovakian border beyond the check point  at night time.

Service dog deprived three Iranians of their dream at the border in Trancarpathia

The border guards of Chop Detachment apprehended three illegal migrants intending to get to European Union by illegal way.

Patrolling the area of the state border, border detail of BS “Novoselytsya” detected the tracks of people’s stay in the locality.

Thinking of possible movement of unfamiliar persons the detail with the service dog organized the check of the locality. The searches of the unwanted guests took not much time – some meters before the border separating Ukraine and Slovakia, the dog “Mobi” indicated the place of detection of the “travelers”. On border guards’ demand to show the documents, three men (DOB 1959, 1983 and 1985) had not any documents and reported about their nationality as Iranians. The point of their destination was European Union.

The trespassers were delivered to border subdivision in order to establish the circumstances of the infringement and to process administrative and procedural documents. Decision about responsibility before the law and their further destiny will be defined by the court.

In 2012 – 152 persons were granted protection in Ukraine

In June 2011, Supreme Council of Ukraine passed the law of Ukraine “About refugees and persons in need of subsidiary or temporary protection” that specifies the conditions and order of protection granting to asylum seekers. Correspondingly to the mentioned Law, refugee status in Ukraine is granted to persons who stay beyond the borders of the country of their citizenship belonging and cannot enjoy the protection of these countries due to grounded fears to become a victim of persecution as to signs of race, religion, nationality, citizenship, belonging to certain social group or political beliefs.
Subsiriary protection is granted to persons who are not refugees according to Refugee Convention of 1951, however they need protection as they have had to arrive to Ukraine or stay in Ukraine because of threat to their lives, safety or freedom in the country of their origin owing to fear of being applied a death punishment or sentence implementation on death punishment or tortures, inhuman or a such that humiliates the dignity, treatment or punishment.
According to the Law refugee or a person in need of subsidiary protection cannot be recognized, besides person that does not correspond to above mentioned criteria as well as person committed of non-political character beyond the borders of Ukraine or that one who before arrival to Ukraine with intention to be recognized as a refugee or person in need of subsidiary protection stayed in a third safe country.

It is worth to mention that above mentioned terms on protection granting correspond to 1951 Convention on Refugee Status and world standards in this field. During the consideration of application on protection granting, the staff of Migration Service checks the truthness of given information by the person and presence of reasons to provide with protection in Ukraine.
There are no any documents that will give the opportunity to apply different legal standards during consideration of applications of asylum seekers depending on the country of their citizenship belonging.
Thus, the order of application consideration and making decision on protection granting is unitary for all citizens from all over the world and giving any advantages to representatives of certain countries is impossible.
According to the order of MOI of Ukraine from 07.09.2011 # №649, body of Migration Service accepts national passport or any other document identifying the personality of the applicant for reservation together with application on refugee  status granting or person in need of subsidiary protection. In accordance with the Articles 8 and 10 of the Law, return of specified documents is carried out in case of reject to the applicant in processing documents and in case if SMS of Ukraine makes decision on reject in recognition as refugee or person in need of subsidiary protection.
Thus, according to the legislation, Migration Service keeps passport documents of all asylum seekers without exception until their applications are completed to be considered. Analogous practice exists in other states as well as in the member-states of European Union.
Altogether, in the course of the year 2012 Migration Service of Ukraine received 1573 applications on protection granting. 152 persons were granted refugee status or subsidiary protection, out of them there were 53 migrants from Afghanistan, 45 from Somalia, 18 – from Syria, 10 – from Iraq. The number of representatives of other countries was not exceeded 10. Besides, the citizens from CIS countries were granted protection in Ukraine, namely 6 persons from Azerbaijan, 1 – from Russia,  1 – from Belarus, 1 – from Kyrgyzstan and 1 from Armenia.
By the beginning of the year 2013,  there were 2435 officially recognized refugees in Ukraine including 107 citizens of Russia.
 

Service dog assisted in detention of three illegal migrants from Georgia

The district inspector of Chop Border Detachment in the area of BS “Guta” noticed the movement of three unfamiliar persons making their way towards the state border on Slovakia. The border detail started for the search of the trespassers. The service dog named Mukhtar assisted in taking the trace of the travelers. Detainees were the native of Georgia, they did not have any documents with them.

As the men explained they intended to get to EU countries for further employment.

At the present moment the circumstances of the infringement are under investigation after which a legal decision will be made concerning the detainees.

Hungry is going to introduce temporary detention of refugees from third countries

Procedure of arrest is planned to be introduced in Hungary. Since the beginning of June of the present year in the neighbouring to Transcarpathian region Hungary persons arrived from the third countries wishing to get refugees status can be arrested.

“Considering the high level of abuse of rights by the refugees as well as unauthorised leaving of places of stay by the persons seeking refugee status in the country, procedure can be introduced on arrest of this category of persons from July 1, 2013 in Hungary” – it is said in the statement at the website of the agency.

It is also mentioned that Minister of Interior of Hungary Shandor Pinter passed corresponding bill for consideration of the Parliament the aim of which is to introduce appropriate European standards and norms” in Hungarian legislation as well as the implementation of the obligations following from the directives of EU.

The conditions of arrest of persons seeking to get asylum in Hungary are planned to be created separately from Centers of Temporary Stay of the Foreigners.

At the same time it planned to introduce alternative to temporary detention, namely the opportunity of persons’ staying at a definite place, obligatory regular reporting or bail.

Palestinian was going to Warsaw by Greek passport

Border guards of the check point “Yagodyn” of Lutsk Detachment apprehended a citizen of Palestine. The foreigner intended to to get illegally to European Union by forged passport of the citizen of Greece. During the passport control the passenger of the train “Kyiv-Warsaw”, the border detail became doubtful as to the reality of the document of one of the passengers and its belonging to the bearer. During the further investigation these doubts were proved with the help of special devices. The passport was forged by means of the change of informational page  with constituent data of the owner. Detainee confessed that in reality he was the citizen of other country and presented his real Palestinian passport due to which he entered Ukraine legally. All circumstances of the cross of the state border are established by the law enforcement agents. Detained citizen is handed over to police officers.

Moldavia was travelled to Ukraine with USSR passport

The citizen having the passport of the citizen of USSR was detained nearby the border on Moldova. Border detail of BS “Velykokomarivka” of Kotovskyi Detachment  stopped the man crossing the border beyond the check point. He presented the passport of the citizen of USSR instead of his real passport (according to his words, 37-year-old citizen of Moldova). The man also had a pack in his hands with 50 hunting cartridges of 12 mm caliber.

Ammunition were confiscated from the man and administrative-procedural documents were processed. The man was handed over to police officers. His further destiny will be decided by the court.

Illegal migrants going to Slovakia were apprehended in Transcarpathia

Border guards of Chop Detachment detained twice migrants from post Soviet area.

At about 6 a.m. after technical devices on border security went off the operative group with the service dog apprehended a man and a woman. The married couple was caught having some metres to reach the border line with Slovakia, informed the border guards that they were the citizens of Russia, the native of Chechnya. However, they could not confirm their nationality by no documents.

Unknown person also intended to cross Ukrainian-Slovakian border late in the evening. But the attempt to avoid the alarm device by being not noticed was unsuccessful. The service dog brought the operative group to the “traveller” at once. The man introduced himself as the citizen of Moldova, and he aslo did not have any documents to prove it.

At the present moment, the trespassers are delivered to border subdivision “Uzhgorod” in order to establish the circumstances of the infringement and process administrative and procedural documents. Decision on responsibility before the law and further destiny of all detainees will be defined by the court.

Igor Mykhailyshyn: Migration rotation is sufficiently decreasing

Because of its geopolitical and geo-economic peculiarities Transcarpathia in the past as well as in modern history is in the very centre of migration activity. The task is to follow all these processes and also to influence upon the peculiarities of work and specified tasks.   – About a year has passed since Migration Service was reformed and reorganized.What is the sense of such reorganizations, what are the pluses and minuses new structure has. And the main thing, how does it influenced upon the citizens having necessity to address with some problems.

– The year 2012 for Head Department of SMS of Ukraine in Transcarpathian oblast passed under the sign of  establishment. Under implementation of the Ukrainian President`s Order from April 6,2011 “Problems of State Migration Service of Ukraine” subdivisions of Department on Citizenship,Immigration and Registration of Physical Persons of MOI have passed into competence of SMS. In the oblast this process passed in organized way, without stir and the creation of the nuances for the citizens.

The Service is the civil one, it is not subordinated to law enforcement bodies. Correspondingly,there is a separate article of budget in the order of financing for support of our work.

Before, the service men were called to other responsibilities as MOI workers – even to support public order. Now, is the other thing.

– It can be said that Migration Service in  a present look is a new organization having not so much gained experience. We cooperate with analogue foreign Services, e.g.with Hungarian Migration Service existing already 12 years. We participate in scientific conferences, seminars on experience exchange, study migration tendencies in the entire world. Joint trainings of the specialists are also conducted. Embassies of neighbouring countries, international structures, NGOs make concessions for us in many issues.

– Do you feel any lack of qualified staff?

– Certainly, no. As the specialist were transferred to the Service being already engaged in migration issues, registration work – so they have experience. Actually, we now think of new fresh staff. Recently, Odessa National Legal Academy has opened a new faculty that prepares young specialists in this field. This year, we send four entrants for studies.

– The Service also carries out a definite control for the movement of the foreign citizens along the country.

– The series of organizational actions are carried out being directed upon the strengthening of control for the state and movement of the foreigners along the territory of Ukraine. There are 231 foreign citizens registered in Head Department, who have documented residence permit. The majority of these foreigners stay on the on the territory of Transcarpathia because of employment at big enterprises of the area  (these are doctors, teachers and also businessmen) and work at religious organizations. There are 1705 foreigners permanently residing in the area.

– It should be mentioned that period of migration boom happened in the second part of 80-s – in the beginning of 90-s gradually passes to relatively stable and sufficiently decrease of migration flow. Thus, last year 418 country fellows were issued departures for permanent residence in the abroad countries, in comparison with the year  2007 this number was in two times higher. The principle countries for emigration Transcarpathian residents traditionally choose Hungary and Czech Republic with which the oblast is historically connected as well as Germany, Israel and Russia,where flows of labour migrants are directed.

Certainly, some factors sufficiently influence upon the state of migration in the area – these are closeness of the borders,economic difficulties,numerous relations abroad.

– So-called illegal migrants are often detained in the oblast…

– Because of its geographical position, the area is specially attracted by “shade” migration. Transcarpathia is a transit territory on the way of illegal migrants’ to the countries of European zone and is the key region where there is accumulation, formation of groups and further smuggling through the state border. There are few of those in need of protection, those who escape the wars and the conflicts in the country of origin among the persons apprehended by law enforcement agents. In 2012 in the frames of the realization of new legislation about refugees, which introduced two new forms of protection -namely temporary and subsidiary –   120 applications on protection were submitted by the foreigners in Refugee Department of Head Administration in Transcarpathian oblast. The biggest number of such applications were submitted by the citizens of Afghanistan and Somalia. In total there are 44 recognized refugees and 39 persons granted subsidiary protection in the statistic registration of territorial body of Migration Service.

Temporary Accommodation Centre for refugees with corpuses functions in the town of Mukachevo and Perechyn that from the time of its foundation accepted about thousands persons; 107 persons stayed there last year, now there are 69 refugees.

Efforts of the workers of Migration Service together with the representatives of international organizations are directed upon the integration of these people into Ukrainian society. At financial support of representation of UNHCR in Belarus, Moldova and Ukraine and its executive partner International Fund of Health and Environment Care “Region of Carpathians”  – NEEKA” in the region a corresponding pilot project has been realized.Head Department of SMS of Ukraine, Oblast Employment Centre, factory “Flekstroniks” are attracted to its realization, the protocol was signed concerning intentions to employ refugees and asylum seekers in Transcarpathian oblast. System monitoring of corresponding vacancies at the local employment market is carried out also for the expenses of the programmes of small grants of UNHCR, individual approach is applied in the issues of integration of refugees in the search of proposals from small and secondary business concerning their employment. Actually, despite all these efforts, no any asylum seeker declared about their wish and did not registered in a specified order at State Employment Centre.

Ukrainian assisted two Russians and Azerbaijanian in getting to Russia

Two citizens of Russia and citizen of Azerbaijan were apprehended in Luhansk oblast. The trespassers were noticed by district inspector of BS “Milove” of Luhansk Detachment. The men were stopped between Ukrainian populated area Milove and Russian one Chertkovo 5 meters before the border. Russians –inhabitants of Rostov oblast of 35 and 41 years old had passports. However, Azerbaijanian travelling without documents reported about loss of his passport on the territory of Ukraine. Soon, inspecting the locality border guards together with workers of State Road Inspection detained our country fellow. In the course of circumstances establishment it was learned that he helped foreigners in getting to the border by car.

Now, the citizen of Ukraine is called to administrative responsibility according to Part 1 Article 206-1 stipulating the fine in the sum of 1700 to 3400 UAH. Concerning other persons the administrative and procedural documents were processed and SSU workers in Luhansk oblast were informed.
