Chechen family with children intended to get to Austria through Transcarpathia

During the last days border guards of Chop Detachment detained 4 citizens of Russia in the area of BS “Uzhgorod” (Slovakian border). Detained illegal migrants were residents of Chechnya, therewith they were spouses. They took two little children (5 and 6 years old) into a trip. It should be mentioned that the family got to the territory of Ukraine legally and with correspondingly processed documents. However, they had to stay in Kyiv. According to the explanations of the very detainees, they planned to get to Austria in order to improve their living conditions. At present, the checking measures are undertaken. Their further destiny will be decided by the court.

Ukrainian-Slovakian area of the border has already become active as to the number of illegal migrants long ago.  Altogether, during the last year the number of attempts to cross the border in this direction decreased in 22%.

Three Afghan travellers were detained nearby the border

Border guards of BS “Milove” in Luhansk region detained three citizens of Afghanistan, who arrived to Ukraine illegally. Law enforcement agents stopped men of Asian appearance nearby the border. It was established that detainees did not have any documents. According to the explanations of the travellers, they were citizens of Afghanistan of the age 21 to 25 years old intending to get to the countries of Western Europe. At the present moment border guards carry out checking measures.

Border guards detained Somalis, who were carried in hands over the river

Border guards of BS “Dilove” of Mukachevo Detachment detained two under age citizens of Somalia. During the check of the vehicles law enforcement agents detected two dark-skinned boys inside the car. They did not have any documents identifying their personality. According to the words of the boys they were 15 and 17 years old and they were citizens of Somalia.  One of the boys was taken to the hospital because he froze his arm and needed medical aid.

Five more travellers were detained by the border guards of BS “Stanchyno-Luhanske” of Luhansk Detachment, who also travelled without documents. Stopping two cars nearby the settlement Gerasymivka, law enforcement agents detected four men and a woman of the age 19-24 years old. They were also citizens of Somalia, who confessed in their intentions to get to the countries of Western Europe.

Border guards detained three citizens ofUkrainewho smuggled these citizens. According to the explanations of 31 and 56-year old Ukrainians, they transported the foreigners illegally through the ford of the river Derkul. Men dressing up the fishing clothes took the migrants on their back in order not to wet their clothes. Detained citizens ofUkrainewere handed over to MOI. All the circumstances of the violation are established now.

Malian intended to get to Europe with another’s document

The citizen of Republic Mali travelling with another’s passport was detained in the check point “Krakivets” by the border guards of Mostytskyi Detachment. During the check of the regular bus “Kyiv-Anzhe (France)” law enforcement agents noticed something strange in the passport document of one of the passengers. During the interview 25-year-old man confessed that he used not his passport for travelling abroad in order to get to Europe. The corresponding documents on administrative prosecution were prepared concerning the violator.

Four more citizens of Georgia were apprehended the same day in Zhytomyr region by the border guards and officers of MOI. The law enforcement agents stopped three men and a woman in Ukrainian village Studenytsya. During the check of their documents border guards and MOI officers detected forged marks, two others did not have any documents at all. Materials are prepared on raising criminal case as to Article 358 of Criminal Code of Ukraine (documents falsification).

13 thousand illegal migrants were expelled from Ukraine in 2011

There are 310 thousand foreigners registered in Ukraine.

In the year 2011,Ukraine expelled 13 thousand illegal migrants. Besides, 55 thousand foreigners and 21 thousand citizens of Ukraine were called to administrative responsibility for the violation of the rules on stay.

Public prosecutor commenced 9 criminal cases according to the results of human rights activity in the sphere of observing the laws on migration and refugees, counteraction to xenophobia display. 229 documents of prosecutor’s reaction were listed. According to the results of their consideration – 164 persons were called to responsibility.

Herewith, General Prosecuting Magistracy of Ukraine made references to necessity of grounding decisions on foreigners’ expel and directed a letter to its regional sub departments, which obliged prosecutors to activate the work in the sphere of counteraction to race and religion intolerance display.
“An attention is paid to the accuracy in defining grounds of migrants’stay in Ukraine, relevance of decisions on refugees’ expel, observance of the rights of the citizens of Ukraine and foreign states in cases on administrative infringements of this category by the bodies of Interior and territorial bodies of Migration Service” – it was said in a statement.

Also General Prosecuting Magistracy (GPM) stresses upon the necessity to ensure the observance of foreigners’ rights and prevention of rouse of national, race and religious hostility during Euro-2012, Football Championship.

GPM mentioned that 310 thousand foreigners are registered in Ukraine and their sufficient number stays in the country without legal grounds.

In the middle of February, Cabinet of Ministers allowed to enter Ukraine and stay for permanent residence for 8 thousand foreigners and stateless persons. In such a way, the government increased this quota for 622 foreigners in comparison with the year 2011.

Lebanese men nevertheless reached the border of Transcarpathia (photo)

On February 19, the border guards of BS “Knyagynya” of Chop Detachment detained two illegal migrants from Lebanon in the course of realization of special measure. Lebanese citizens, the personality of which was already established, were detected and detained in the area of corresponding Border Service, in the suburb of the village Sol. They tried to get one of the countries of European Union. At present time the administrative and procedural actions and operative-checking measures are carried out. Decision on responsibility before the law and their further destiny will be made by the court.

Resident of Transcarpathia was sentenced to 5 years of imprisonment for smuggling

For border Transcarpathia illegal business on smuggling migrants to the countries of European Union from Asian and African countries has become a usual phenomenon already for a long time.  Many international crime syndicates make a million fortune on it. Some local residents of border regions of Transcarpathia snatch a large sum in this business, who hide illegal migrants for a definite fee and assist in their transportation abroad knowing the locality well. Though, the law enforcement agent unmasked some serious criminal groups in the course of some past years and also those with international relations, new and new groupings appear each time. This criminal became too eager.

33-year-old resident of the village Dubrynychi, Perechyn district V. also was caught at this prohibited trade. As follows from the materials of bill of indictment, this guy agreed to participate in organization of illegal transportation of illegal migrants through the state border ofUkraineto Slovakian republic last year in June. Evidently, he did it not for the first time.

At night a person delivered four citizens ofAfghanistanto V. (there were two minors and their mother among them). During some days, the young boy hided the migrants at his house. Certainly, he did it for nothing. He waited when the migrants would be taken by other participants of criminal group aiming at illegal transpiration through the state border ofUkraine. However, law enforcement agents learned about this and then V. with his “lodgers” were detained.

The guy was called to criminal responsibility for assistance in organization of smuggling illegal migrants through the border in accordance with Article 2 of Criminal Code of Ukraine. After investigation had finished the case was passed to the court and V. was condemned to five years of imprisonment by the sentence of Perechyn District Court in August 2011.

However, the court freed him from serving his sentence with period of probation for three years. He was also entrusted with the duty not to leaveUkrainefor permanent residence without permission of Criminal Executive Inspection, report about the change of his place of residence, work or education and from time to time to come for registration at these bodies.

Perechyn Prosecutor’s Office appealed against the decisions of the court of the first instance regarding the assigned punishment to be too lenient, which does not correspond to gravity of the violation. Indeed, the sanction of the Article of CC, as to which the smuggler of illegal migrants was condemned, stipulates the real punishment – for the period of 3 to 7 years of imprisonment with confiscation of instruments of crime. The court also did not take into account the fact that accused was called to criminal responsibility not for the first time. That is why the prosecutor asked in his appeal to cancel the sentence and resolve a new one – impose more severe punishment without the period of probation.

Filed appeal in December 2011 was considered by the Appeal Court of Transcarpathian region. Weighing the facts that condemned person has two children, he repented at investigation and assisted in disclosure of the crime, theRegional Courtleft him the previous conditional term of sentence.

Somalis stopped hunger strike in Zhuravychi

The migrants from Somalia holding at Temporary Holding Facilities in Volyn and Chernigiv stop their hunger strike.

It is said in the letter to Cabinet of Ministers published by Ukrainian Refugee Council that Somalis stopped their hunger strike about six weeks.

“We have also decided to fill in the applications for complementary protection as we understand that the Government has now agreed that no Somali who claims asylum will be treated as ‘manifestly unfounded’ and rejected quickly – as has been the case up to now” – the authors of the letter mark.

Besides, Somalis intend to appeal against the detention at Ukrainian courts”.

“The Government of Ukraine and Ukrainian State Migration Service know well that our detention is illegal on the basis of the juridical arguments laid out in statements from the Ukrainian Refugee Council, the United Nations High Commissioner for Refugees, Amnesty International and Human Rights Watch” – refugees pointed out.

In its turn, the Ukrainian Refugee Council hopes that submission of Somalis’ applications will be quick, impartial and that situation of the applicants will be considered taking into account information about the country of their origin and due professionalism.
Besides, about 80 Somalis informed representation of UNHCR about their wish to get asylum in Ukraine, however they were rejected. Thus, they made a protest and went on hunger strike.

In January, State Migration Service announced that release of Somali migrants who went on hunger strike is impossible at the present moment, and their strike is “a play to audience.

Migrant from Vietname intended to run from border guards in Mukachevo

In the frames of realization of operative-preventive activities “Migrant”, the border guards of Mukachevo Detachment detected the citizen of Vietname at the railway station “Mukachevo”, who tried to avoid the check of the documents.  Getting off the train, man made his way along the platform to the opposite side of the railway station. Ignoring the demand of law enforcement agents to stop for checking documents, the citizens continued to move to concrete fecnce, where he was detained by the border detail.  During the interview, it was established that the man did not have any documents. As it was learned later, the present citizen has already had an experience in communication with the border guards.

In January 2012, he was already detained in the area of Chop Border Detachment for the attempt to cross the state border ofUkraineand was called to administrative responsibility. At that time, a decision was made on compulsory return to the country of residence, but the man did not fulfil this decision not loosing all hopes to get to European Union.

This citizen was called to administrative responsibility; his future destiny will be decided by the court.
