Four minors were in the group of illegal migrants from Afghanistan

Border guards of BS “Vilok” of Mukachevo Detachment apprehended 8 citizens of Afghanistan nearby the border. Information about the appearance of unknown persons in the border area was received by the law enforcement agents from local residents. Starting to the place, border guards detained 6 persons, and in the course of further search, two more unfamiliar persons were detected at the bank of the river Tysa. Soon, it became known that all detainees were the citizens of Afghanistan. There was a family of 5 persons – father, mother and three more children of the age 10 to 16 years old – in the group of the illegal migrants. There were also 2 more adult men and 17-year-old boy. All detainees intended to get to Europe in order to improve their life conditions. Besides, detained persons reported that they as if appealed for refugee status granting in Ukraine. However, border guards established that corresponding applications were not submitted by the Afghans. Now, the citizens of Afghanistan are handed over to representatives of Migration Service of Transcarpathian oblast.

Three citizens of Nigeria were getting to Ukraine with forged residence certificates

In the airport of Simferopol border guards apprehended 3 citizens of Nigeria with forged documents. The trespassers were detected by the workers of State Border Service among the passengers arriving by the flight from Tashkent. In the course of the border control “travellers” – two women and a man gave forged Ukrainian temporary residence certificates for the check. Now, corresponding procedural documents are processed as to the violators and they are refused in entrance to the territory of our country.

Former chief of Refugee Department is sentenced to 5 years of imprisonment

Uzhgorod Municipal Regional Court announced a sentence as to Refugee Department of Head Department of State Migration Service in Transcarpathian oblast.

The official demanded and received a bribe in the sum of 16000 from the citizen A. in August 2012. He is sentenced according to Part 3 Article 368 of Crime Code (bribe receiving) of Ukraine with restraint, forfeit of the right to occupy posts connected with implementation of organizational-regulatory or administrative functions for three years, with probation period for 1 year.

Border guards apprehended 5 persons with forged and someone’s passports

A trespasser from western Asia was detained at the railway station of the check point “Yagodyn”. During the border-customs registration of the train “Kyiv-Warsaw” border guards of Lutsk Detachment detected a foreigner that intended to get to Poland with someone’s passport. With the help of special devices, it was established that document was valid and it did not belong to the bearer.

Two more violators were apprehended by the border guards of Ismail Detachment in Odessa oblast. They were detected in regular bus “Odessa-Varna” (Bulgaria) directing through the check point “Vynogradivka”. During the check in of the passengers, two citizens of Russia presented forged documents of the citizens of Bulgaria for passport control, in which the pages with constituent date were changed.

Besides, in the airport Boryspil border guards of separate check point “Kyiv” 34-year-old citizen of Ukraine was detained during the check in of the passengers making their way to Vienna. The man presented a forged passport of the citizen of Estonia. Ukrainian explained that he bought this document during his stay abroad for € 3500 with the aim of legalization. Also at the same airport, 25-year-old man was also apprehended, who arrived by the flight from Dubai. As it was established, the passenger was a person without citizenship from Syria, however he gave the passport of the citizen of Bulgaria for control. At the present moment, the man is returned by a return flight to the country of departure.

The main channel of illegal transportation goes through Transcarpathia

Our time is characterized by extension of scales of migration processes in the world, broadening and development of relations and integration between the countries. Migrants have always brought their impact into development of any country, its economic, social and cultural constituent.

Nowadays, as to the size of migration the corridor Mexico – USA is supposed to be the largest one, the volumes of which exceed 10 million persons every year. In addition, one of the greatest corridors are Turkey-Germany, Algeria-France. But if examining migration to EU countries as a whole so such a corridor is not worse and even prevail in the direction to Mexico – USA.

We, indeed, will examine illegal migration, the flows of which go through our country. Due to its profitable territorial location, Ukraine has become a transit country for the flow of migrants to EU countries, as our country has common land borders with Romania, Poland, Slovakia and Hungary placed for thousand kilometers. In spite of its economic profit, location of Ukraine is comfortable for illegal migration, i.e. illegal movements beyond the check points or concealment from border and customs control. Many people, in particular from Arabic and Muslim countries, wish to reach wealthy and successful EU countries. Citizens of Pakistan, Afghanistan, Iraq, Caucasian Republics of RF, Palestine, Nigeria, Syria, Ethiopia, Sudan, Egypt are among the main flows of illegal migrants and asylum seekers who arrive to our country or, what happens more often, use it as transit zone.

It is worth to mark that in 80% of cases illegal migration through the territory of Ukraine is not spontaneous, vice-versa it is a well organized and regulated business for years. Few of migrants are able to venture to such “a trip” on their own. Usually, already in the country of their origin they make agreement for illegal transportation to EU countries with international criminality specializing in smuggling people. The price for these kind of services are fluctuating from $4 to $7 thousand depending on different nuances, e.g. country of origin, transit route, number of mediators, period of transportation. Some persons wishing to get to EU sell their flats, houses, the last property in order to gather these sums, especially if the whole family decides to emigrate. The better option for asylum seekers is an occasion when they manage to open tourist visa to Ukraine, so in such a case they would have to cross only one border – Ukraine-EU.

It is not possible for migrants from all countries to get tourist visa, however sometimes issue of such a visa is included into the cost of the “services” of some smugglers. But in many cases migrants cross some more borders before reaching Ukraine. The main migration flow is directed through Russian Federation. In this case, the general sum of the transportation to EU countries increases from $4 thousand to $7 thousand, and sometimes even more. The very transportation through Russian-Ukrainian border costs $ 1.5-2.5 thousand. As a rule, this distance is supposed to be easy as the border length is hundreds kilometers and generally it is guarded not so thoroughly as the state border with EU. According to the words of illegal migrants, they cross the state border mostly at nights, in the forests, marsh and adverse terrains in accompaniment of the smugglers.

There are also exotic ways of getting to Ukraine, in particular by seaway. Some asylum seekers from Eritrea told us that they reached our country by boat through the Black Sea, certainly, also illegally and beyond the check point.

Usually after overcoming the first stage (Ukrainian border), the smugglers deliver illegal migrants closer to the western border of Ukraine, they often hold them in the “settlings” in Vinnytsya, Khmelnytskyi and Ternoil oblasts. The migrants sit snug there a week or two at specially rented flats or hotels, the owners of which are mainly “in share”, or for they are silent a definite sum. After a certain number of persons is collected and “favorable time” comes, the malefactors intend to take migrants to EU countries. They try it because success of such an attempt generally does not exceed 40-60%. Migrants, of course, do not know about this as they are told fairy tales about guaranteed reaching EU in order smugglers get the necessary sum. Though it should be mentioned that there are such channels of smuggling efficiency of which is about 100%, but they are few and most likely these smugglers are assisted…

The most part of the migrants’ flow is detected and stopped by the workers of Border Service of Ukraine. After illegal migrants are put to Temporary Holding Centers and special camps, as e.g. in the village of Zhuravychi, in Volyn oblast, where these people are awaiting for deportation to the country of origin.

The chief channel of illegal transportation goes through Transcarpathian oblast, and Lvov oblast is used mainly as transit zone in rather less degree for crossing the border. Transcarpathian oblast has the common border with three EU countries, besides the relief of the region, mountains and passes assist in illegal migration that complicate the work of the border guards of Ukraine and their European colleagues. The flow of illegal migrants through Transcarpathia exceeds the Lvov direction in 2-3 times.

The peak of migration through Ukraine fell on 1990-2000s, which was activated sufficiently after 2010 when Ukraine signed the Law about Readmission in accordance with which from January 1, 2010 the country became to be obliged to accept…tens thousand illegal migrants from EU, who got there through the territory of Ukraine. However, few of illegal migrants were glad by the perspective to be deported already from EU countries to Ukraine.

There is also a way how to avoid deportation to your country even after detention during the illegal cross of the border. Many detainees write application to municipal department of Migration Service of Ukraine asking for refugee status or apply as persons in need of subsidiary protection. The majority of the migrants really run from political or religious pursuit in their country.

Fathi from Palestinian, among such people, has agreed to tell his story. The boy arrived to Ukraine escaping the pursuit of HAMAS. Working in the field of journalism, Fathi wrote articles, satirical poems, libels and in general he was engaged in oppositional activity. Ruling party did not like some of his publications and the boy was arrested repeatedly, he was not allowed to make his job by the law. Receiving necessary documents on the territory controlled by Fathom, the boy left the country. In Ukraine he has lived already for several years, he learns Ukrainian and Russian and he says that he likes to stay in our country, he wants to integrate into society entirely, to marry and become a respectable citizen. Not long ago, Fathi become a step closer to his goal receiving refugee status in Ukraine. Now, the young man works at two places and plans to start his own business in accordance with the integration programme of UNHCR, which grants refugees $10 000 for the starting own business having a good business plan. The boy’s family long since is occupied by making furniture from marble, so Fathi is eager to continue a family business already in Ukraine.

However, receiving refugee status in Ukraine is too difficult than in EU. It may sound ironic, but it is a fact. The reason of this situation is banal and simple – financial constituent. The country entrusts many social components when granting refugee status. According to statistic data, out of 10 applications about refugee status granting or subsidiary protection in better case one is satisfied. However, it should be confessed that often rejects are reasonable and grounded. It is said about the cases of “economic migration, when the person is not threatened with anything in his country, and the goal of his trip is search of better future, so according to the law such a person cannot be recognized as a refugee. There are cases, when people present untruthful information about their personality. Though, many are really in need of protection and asylum as return to their motherland for them is terribly dangerous. Without exceptions, UNHCR and its regional partners help everybody – organization NEEKA in Lviv and Transcarpathian oblasts, which at the assistance of UNCR provides asylum seekers with free of charge legal and other kinds of aid.

Not always, reject in refugee status granting means further deportation of the person. Asylum seekers have a right to file to a court for the body of Migration Service of Ukraine and then appeal in case of reject of the court of the first instance. According to the law, in the course of court consideration of the case, claimants (illegal migrants) receive temporary residential permit on the territory of Ukraine and cases the like are dragged on for years.

Namely Samir and Mukhammad from Iraq acted in such a way, who have complained against the decision already for years. During this period, they had time to marry and acquired children, and it is a guarantee of legalization. Samir is happy that right here in Ukraine he managed to find his destiny and happiness. The single thing that still makes him upset is impossibility to find a job. In Iraq the man worked at five-star hotel “Baghdad”, he has good experience, however in Ukraine it is difficult to get job: “They do not want to hire”, – he complains. Mukhammad is in similar situation.

However, there is another side of the medal: there are quite a lot cases when people apply for getting refugee status in order to win time for the next quick march to Europe, from the second (third) time many succeed to reach their goal…

Russian without passport got over the border from Slovakia to Transcarpathia

Border guards of Chop Detachment detained a man, who crossed the state border from Slovakia to Ukraine illegally. He made a decision to overcome the state border illegally at night time in the border area of BS “Palad Komarivtsi”. Border guards of mentioned department went off immediately and already in some metres before the border they stopped illegal “trip” of the trespasser. Detained man introduced himself as citizen of Russian Federation, however, he could not present any identification documents to border guards. In the course of establishment of infringement circumstances, 24-year-old Russian told that he lost his documents while staying in Germany and he tried to get to Russia in order to renew them. As to chosen route of the trip, he explained that during the travel to the east he used navigation cards from the Internet due to which he got to Velykyi Kapushan (Slovakia) and intended to get to Ukraine, where he was apprehended by the border guards. Administrative and procedural document on illegal cross of the state border were processed against the trespasser and according to the court decision he was called to administrative responsibility in the form of administrative arrest. After serving defined punishment, the violator was handed over to Slovakian law enforcement agents in accordance with Agreement between Ukraine and European Community about readmission of persons.

(Un)safe Ukraine for asylum seekers

Asylum seekers crossing Ukrainian border cannot always rely on help. The UN Refugee Agency (UNHCR) in Ukraine, Belarus and Moldova regards that nowadays Ukraine is not a safe country for refugees.

“At the present stage, Ukraine cannot be supposed to be safe country for all refugees. We cannot say that the system works in a full measure and protects all.” – Oldrih Andrisek, regional representative of Agency, admitted at the meeting with the journalists in Kyiv.

He considers that “according to statistic, there are certain nationalities that are more difficult to get or are issued refugee status at least.”

Answering the questions of BBC Ukraine about why Ukrainian governmental bodies reject in issuing political asylum to refugees from former Soviet Republics, Oldrih Andrisek reported: “We cannot assert that it is a rule, however, unfortunately there were really situations when the access of people to international human rights organizations protecting refugee rights was not guaranteed”.

Presented information by UNHCR testifies that in the course of last five years refugee status was granted mainly to migrants from Afghanistan, Palestine, Somalia, Iraq, Syria. Such a status was received by representatives of Russia only in 2009 and 2009 for the last time, Belarus – in 2008-2010.

Oldrih Andrisek accepted that according to statistics, there were more rejects in granting refugee status to migrants from Russia than to representatives of other countries.  “I would not tell that it is said about some system, but sometimes it really happens due to reasons to which there are no explanations”, – he said.

Simultaneously, Viktor Sheibut, the first head deputy of State Migration Service, who directly takes part in resolution of final decisions as to asylum granting, assured that on issues of refugee status granting Migration Service “first of all implements humanitarian mission and does not have any political bias.”

“In every separate case all information is learned that can be received by the specialists of Migration Service as well as due to the results of interview with an applicant. Only concrete life circumstances of particular person influence upon the final decision on protection granting, and not the country of origin or political expediency”, – Viktor Sheibut told.

Rozvozhaev and others

In 2012 human rights activists declared about a series of cases when, on their opinion, decision of Ukraine was made on extradition of the citizens  – migrants from former Soviet Republics – exposed these people to danger.

Representative of Migration Service Viktor Sheibut assures that cases of reject in asylum granting are rare.

The last example – mysterious disappearance of Leonid Rozvazhaev in Ukraine, the member of opposition Russian Party “Left front”. In fact, Ukrainian Prosecutor’s Office made a decision about closing of criminal case on his disappearance based on the reply of State Border Guard Service about his entrance to Ukraine and departure to Russia legally. However, still it is unknown, not for certain, what happened to Leonid Rozvazhaev on the territory of Ukraine. As it was informed by UNHCR, capital Prosecutor’s Office investigated one more criminal case – Application for stealing the very Leonid Rozvazhaev and his lawyers.

In August of the previous year, UNHCR expressed its concernment as to fate of two migrants from Northern Caucasia. Despite of the right on access to detainees at trial centre of Kyiv and Kharkiv, UNHCR could not even get reliable information about the place of asylum seekers’ stay.

In March 2012, UNO Agency censured the reject in access of two citizens of Kirghizia to the territory of Ukraine at Kyiv airport “Boryspil”.

Will there be more political refugees in 2013?

At the same time, representative of UNHCR Oldrih Andrisek expressed his hope that in the year 2013 situation in Ukraine will be changed essentially.

“At this stage Ukraine cannot be regarded as safe country for all refugees. We cannot say that the system works in a full measure and protects all”.

These hopes are connected first with the fact that an Article has appeared in a new Criminal Procedural Code (CPC) that reflects the content of International Conventions concerning asylum seekers.

Before, extradition from Ukraine was impossible only in case if a person had already had a refugee status. New CPC stipulates that governmental bodies do not have a right to deport a person beyond the borders of Ukraine from the moment when he/she has made an application about his/her wish to get political asylum and until the final decision as to his/her fate is made. In other words, asylum seekers “did not live till” getting refugee status before and State Migration Service made a resolution on the extradition.

Oldrih Andrisek stresses that now everything would have to have another look. Any foreigners can make an application with request about asylum immediately after arrival to Ukraine.

“If a person will declare about his/her pursue on political motives and that he/she wants to get political refugee status in any form – written or oral, so Border Service is obliged to transmit this information to State Migration Service, which is the body that makes the final decision on the extradition or issue of the status of political refugee”, – Mr. Andrisek marked. He also told that announcement of a person into an international search by INTERPOL – rather often oppositionists from the countries of former USSR – “yet does not mean that this person is guilty”.

“Unfortunately, there are political opponents of the power as well in the lists of INTERPOL and not only the criminal offenders. On this purpose, the interlocutions are conducted. If the person is called a criminal offender at the site of INTERPOL, and there are all signs of persecution with political goal, so this person deserves for international protection and he/she has to get such a protection. As INTERPOL cannot be an instrument of political punishment. It is foreseen in the Article of this organization as well”, – Oldrih Andrisek said.

However, according to the words of Andrisek, it would be incorrectly to say that Ukraine deserves just for critics. “Thousand persons got asylum, many of them have naturalized and have Ukrainian passports”, – he adds.

The first head deputy of State Migration Service, Viktor Sheibut, stressed that Ukraine “has recreated from the transit country to the country of settling”. The representative of Migration Service affirms that cases of reject in protection granting are rare and that they also exist in the countries of Europe.

In Transcarpathia eight Afghans tried to swim over the river Tysa to get to EU

Three men with women and children got to the river Tysa and wanted to try to cross the full-flowing river. The citizens were detained by Transcarpathian border guards.

It is the first case of attempt to cross the state border illegally in 2013.

It was informed by the chief of Transcarpathian Regional Department of State Border Service of Ukraine, Artur Gorobenko during the meeting with the governor of Transcarpathia, Aleksandr Ledyda.

At the checkpoint “Vilok” the first attempt of illegal cross of the state border was fixed this year. Border guards apprehended 8 citizens of Afghanistan – three men with women and children. They succeeded to get to the river, but the passage through the Tysa they would not probably survive.

It was managed to detain illegal migrants due to watchfulness of local resident – the man noticing the group of suspicious people informed border guards about it.

Cameroon man was apprehended in the airport “Zhulyany”

Border guards apprehended a citizen of Cameroon in the airport “Zhulyany”, who made his way to Bergamo (Italy). During the control of the documents of 19-year-old man, border guards detected forged Ukrainian residence certificate and Schengen visa. Now, the detainees is passed to MOI bodies.

Transcarpathian succeeded to smuggle 19 illegal migrants over the border

Sentence of Uzhgorod Municipal Regional Court came into force concerning 55-year-old local resident, native of Irshava region – one of the member of organized criminal grouping, which tried to smuggle 19 illegal migrants through the state border.

In 2009, the resident of v.Zarechie, Irshava region together with other local residents and a person from the village of Vlasovka, Krasnodon region, Luhansk oblast, planned illegal transportation of foreign citizens through Ukrainian-Russian border. The malefactors sought up a group of illegal migrants in the capital of Russian Federation and from there they intended to smuggle them through Ukraine to EU countries. Criminals were acting on the clear scheme. Transcarpathian men got to the suburbs of Moscow by truck, where they met 19 illegal migrants – native of India, Pakistan and Sri Lanka. First, they delivered secretly illegal migrants to the area adjoining to the line of the state border of Russia and Ukraine. Then migrants were passed to Luhansk accomplice smuggling foreigners beyond the check point through Russian-Ukrainian border.

These criminals planned to transport the group of illegal migrants by the truck from Luhansk region to Transcarpathia. The same day, malefactors and foreigners were detected and arrested by law enforcement agents, however 55-year-old Transcarpathian managed to escape.

In the frames of criminal case instituted according to Part 2 Article 332 (illegal transportation of persons through the state border of Ukraine committed as to preliminary agreement by the group of persons), fugitive was announced in the search. In June 2012, Transcarpathian SSU workers arrested him. Uzhgorod Municipal Court recognized this citizen of Ukraine as guilty and appointed him punishment in the form of imprisonment for 4 years with determined probationary term for 2 years. The same punishment was appointed by the court to his accomplices, resident of Irshana – in April 2011 and the native of Luhansk region – in February 2010.
