Somali pirates and a resident from Uzhgorod were apprehended at Kyiv-Chop highway

Four citizens of Somalia were detained at highway Kyiv-Chop in Rovno region. It happened nearby the village Koryst in Koretskyi district. 22-year-old Ahmed Mukhamud Abdi, 16-year-old Mohamed Iidl Hasan, 15-year-old Ali Mohamed Ali and 17-year-old Ahmed Moamed Hasan crossed state border of Ukraine illegally. They were in the car driven by 33-year-old resident of Uzhgorod. The car was stopped because of exceeded speed by road-patrol service. During the check of documents four Somali citizens did not have any corresponding documents permitting them to stay in Ukraine. The foreigners and a driver were sent to Police District Department. The driver of the car explained that he was travelling from Kyiv to Uzhgorod. At the exit of the city he was stopped by four boys who asked in Russian for a lift to Lvov. They promised to fuel the car for this service. He willingly agreed to take the fellow travelers. The Somali boys told that they did not want to be pirates on their motherland thus they started to look for the job in Europe and in Ukraine they turned out occasionally.  

According to the Law about legal status of the foreigners, citizens of Somalia will be sent to TAC in Volyn after court decision as they have violated the rules on stay on the territory of Ukraine. Then the foreigners will be expelled from Ukraine.

There is violation of refugees’ rights and freedom of peace meetings in Ukraine

Amnesty International published annual report about the state of the human rights in the whole world. International experts marked that the rights of the refugees were violated and freedom of meetings was limited in 2009 in Ukraine.

“Ukraine has not stopped to violate the right for asylum: the sufficient fair procedures on asylum granting were absent. Besides asylum seekers and refugees were sent from country by force where their rights could be rudely broken” – it is said in the report.

Amnesty international reminds that it addressed to Ukrainian government during the year concerning four cases of similar accidents. “On August 25, 2009 amendment to resolution of Cabinet of Ministers about order of the entrance of foreigners and persons without citizenship to Ukraine has come into effect. Citizens of certain listed countries in the document and also persons without citizenship now have to have the least 12 620 UAH. “Appliance of such rules to asylum seekers contradicts international law about refugees and is compared to extradition”, – it is stressed in the report.  

According to experts’ evaluations, refugees and asylum seekers were threatened with compulsory deportation from Ukraine. “Persons detained aiming at further deportation did not have any opportunities to appeal against deportation and commitment. Power appeared to be unable to resist attack on racist grounds properly. Messages about tortures and cruel treatment with detainees at police station continued to be received, and guilty persons in violation of human rights left unpunished. Freedom of meetings, as before, was in danger”, – it is specified in the document.

Besides, it is also reported that from June 3, 2009 Parliament resolved a bill in the first reading “About order of organization and implementation of peace activities”. “Non-governmental organizations criticized the bill for non-conformity to international standards in the field of human rights. According to this document, any action to be held should be informed about 5 days before, no spontaneous meetings are admitted, it is permitted to law enforcement agents to use force, however nothing is said about requirements to limited activities. Statement about government’s obligation to keep human rights at peace meetings is absent in the bill”, – it is underlined in the report.

Generally according to the conclusions of Amnesty International, 81 out of 111 states (including 7 out of 12 countries of G20) have not joined to International Crime Court yet. 61 countries accused of human rights violation have not taken responsibility yet; not less than in 111 countries people are put to torture and cruel treatment, not less than in 96 countries freedom of speech is limited, not less than in 55 countries unfair court sittings took place; not less than in 48 countries prisoners of conscience are under arrest.

 “Prisoners of conscience are in prison in 30% out of the amount of all countries and in42% from the number of G20 countries. Freedom of speech is limited in 60% of all countries and in 53% in G20 countries. Unfair court sittings take place in 35% of all countries, and in 47% of G20 countries”, – it is specified in the report.

20 illegal migrants with a guide were detained in Slovakia

The Slovakian border guards detained 21 illegal migrants who crossed Ukrainian border from Transcarpathian side. According to information of press-secretary of Administration of Border Police of Sobrantce Kopernichka Agnessa, from May 17 till 20, 2010 the following persons trespassed Ukrainian-Slovakian border: 6 Moldavians, 4 Georgians, 4 Afghanis, 2 Ukrainians, 2 Pakistanis, 1 Chinese, 1 Russian and 1 Somali. 10 foreigners will be sent back to Ukraine, two Georgians are still under guard at police station. A man from Transcarpathia is accused in people’s smuggling. He is detained until the complete clarification of all circumstances.

The residents of Volyn region were driving the illegal migrants to the border – sellers from Troeschyna and a student

Three illegal migrants from Pakistan traveling with two Ukrainians to the border on Poland were detained in Volyn region during the joint operation of the officers of Lutsk Border Detachment and lawmen of SSU. Their car was stopped on the road “Lutsk-Volodymyr-Volynskyi”. A criminal case was commenced against one Ukrainian man for organization of illegal passing of the persons through the border.

Concerning illegal migrants – two of them had been working at Kyiv market “Troeschyna” before, and the third one came to the capital of Ukraine to become a doctor. They confessed that their plan was to get to the countries of European countries and they paid smugglers $ 5 000 for this kind of services.

A smuggler and 5 illegal migrants from Afghanistan were apprehended in Transcarpathia

The detail “Border patrol” during their service at Ukrainian-Hungarian border noticed the movement of unfamiliar persons in the area of Department of Border Service “Goronglab” of Mukachevo Border Detachment. Afterwards the border detail detained 1 citizen of Ukraine for the attempt to get illegally persons from Ukraine to Hungary in the distance of 1 km from the state border line making a warning shoot. In the course of further operative-searching actions the border guards apprehended 5 more citizens of Afghanistan in the distance of 500 m from the border line. According to the words of the detainees they were delivered to Ukraine illegally by some unfamiliar persons from Moscow where they arrived 1,5-2 months ago. They were taken to Transcarpathia by different cars mainly in the dark time of the day. The detainees were 3 men, 1 woman and 1 child trying to get illegally to the countries of European Union. Now the filtration measures are taken to the detainees.

Illegal migrants crossed Ukrainian border and “got” to Slovakia

On May 12 and 14, the border police of Slovakian Republic caught two groups of illegal migrants at Slovakian-Ukrainian border who got to their territory from the side of Transcarpathian region.  The officers from several Departments of border police arrested one group of illegal migrants on May 12 and later on May 14 the second group was caught at the border “Ukraine-Slovakia”.

The first group of violators was detected not far from the populated area Velykie Selmentsy. Three Somalis and one Pakistani were detained nearby crossing “Ublya-Malyi Bereznyi”. The second group of violators: two Chechens and one Ukrainian were apprehended nearby the village Vyshne Nemetske.

Now an investigation is carried out upon the ways the citizen of Transcarpathia “took” 6 illegal migrants to the territory of Slovakia without border control.  An inquiry on this point has been sent to State Border Service of Ukraine. All violators of the border are now under control of police.

Ukraine becomes a leader as to number of illegal migrants caught at the border

Ukraine is in the lead as to number of illegal migrants detained at the Polish border. Such a statistics for the year 2009 was published by EU agency on policy coordination at the borders of Frontex. Namely Ukrainian citizens are the most number among returned from EU according to Readmission Agreement. Citizens of Ukraine are often refused in entering the territory of European Union. In 2009 – 19 thousand Ukrainians were rejected and 95% of all rejections took place at the Polish border. The reject is caused by visa absence or residential certificate, documents proving the goal of the trip or costs sufficient for stay in EU.

According to the words of Andjey Pylyshkevych, director of Administration on Foreigners’ Affairs of Head Commandant’s Office of Polish Border Service, only in 2009 – 308 Ukrainians were apprehended for attempt to cross the border with the violation of the rules, in comparison Russians were 48 persons, from Moldavia – 15, Belorussia – 6. “I understand the attempts of the Ukrainians to get to our country – as the salaries in Poland are higher. I am not against Ukrainians to work here, but it should be legally”, – reported Mr. Pylyshkevych.

According to data of Ministry of Labour and Social Policy of Poland, the average salary including taxes in the country comprises 2,4-2,6 zloty (6.4-7 thousand UAH). That is why, on Andjey Pylyshkevych’s opinion illegal migrants go to Poland to get job or use this country as a transit one on the way to Western Europe. At the same time Ukraine becomes a leader in number of legally employed persons in Poland. According to information of Commandant’s Office of Border Service, only in the second half of the year 2009 there were about 19,2 thousand those persons (growth up to 100$ in comparison with January-June 2009).

Ad interim, Sergiy Oliynyk director of All-Ukrainian Trade Union of working migrants in Ukraine and beyond its borders regards Poland as one of the less attractive countries for Ukrainian migrants. “The most successful country for migrants from Ukraine is Ireland. You can earn € 1000 per week. And the most unfortunate country is Poland where the salary comprises only $400-450 per month, however one has to spend much more for every day needs and attitude to migrants is not the best. Oliynyk is certain of the main reason Ukrainians leave the country is unemployment. As to statistics present in Trade Union, 65 thousand Ukrainians legally emigrated in 2007, 2008 – 72 thousand, and in 2009 – 80 thousand. Fight against the massive flow of the citizens can be carried out only by means of creation of new working places in the country.   

Deputy head of Committee of Supreme Council on human rights, national minorities and international relations, Ivan Popesku (Party of Regions) convinced that Cabinet of Ministers actively solves this problem: “A bilateral agreement between Ukraine and EU is necessary about abolishment of visa regime which will favour the legalization of migrants. Economic situation should be improved inside the country in order the enterprises start to works again, people will have work and there will be no need to go somewhere for emolument”.

8 illegal Armenian migrants were hiding in the forest nearby Ukrainian-Polish border

Illegal migrants attempting to get illegally to Poland were detected 100 meters before the state border by the officers of Department of BS “Rava-Ruska”. Early in the morning the traces of group of people moving towards the border were noticed by one of the details. The reaction groups were sent for searches of the violators. In some hours the lawmen found illegal migrants (5 adults and 3 children) with the help of a service dog Sarmat. They were hiding in the forest belt and were waiting for an opportune moment to get over the border. The travelers did not have any documents. They called themselves the citizens of Armenia. Some of them were already detained at illegal cross of the border. The migrants were delivered to border subdivision. The circumstances of violation and participating persons are under identification.

Generally, in the course of three weekends the officers of SBS detained 66 violators for illegal cross of the state border.

Illegal Moldavians were detained at coming out of the train

The group of illegal migrants – 4 men and 1 woman of the age 19-25 years old – were detained in the check point “Chop-railway station”. Detail watching the duty paid attention to suspicious persons who came out of the train “Odessa-Uzhgorod”. The travelers, citizens of Moldova, were invited to a service premise. During the interview the lawmen were successful to establish that these persons were going to Italy. They arrived to Transcarpathian region to get illegally to one of EU countries. The border guards prepared papers on administrative breach; the further destiny of Moldavians will be decided by the court.

The border guards of Chop Detachment caught again 8 migrants from Somalia

The group of 8 violators was detained 50 meters before the Slovakian border by detail of BS “Stuzhtsya” of Chop Detachment of SBS (Transcarpathian region). The detainees were citizens of Somalia of the age 20-24 years old. As it was cleared out, they broke Ukrainian border legislation not for the first time.6 illegal migrants were caught before during their attempt to cross the Ukrainian-Hungarian border, two more – were arrested in Uzhgorod for breaking the rules of their stay in Ukraine. After the first meeting with the lawmen all foreigners received certificates about application submission to Migration Service of Transcarpathian region on refugee status granting . Temporary legalization Somalis used for repeated attempt to get the countries of European Union. Now the detainees are in TDC of Chop Detachment. The circumstances of violation and persons participating to its organization are now investigating.
