Since March 3, 2014 the number of Ukrainian citizens applying for asylum in the countries of European Union has dramatically increased and continues to grow up.

The executive director of European Office on Asylum Seekers Support, Robert Wisser mentioned in the interview to EurActiv. He said that the citizens of Ukraine make up the biggest group of those arriving from Eastern Europe among the asylum seekers. Ukraine possesses the sixth place as to the biggest flow of refugees to EU.  Besides, this list involves Syria, Eritrea, Iraq, Somali, Nigeria and Ukraine.

“Ukraine’s peculiarity is that it has not been the country for asylum seekers before the conflict in Donbass”, – Robert Wisser reported.  Also, according to his words, Ukraine completely differs from other countries because all Ukrainians arrive to European Union on legal basis, receiving visa and applying for asylum granting already residing on the legal basis, often with employment permit.

In addition, he informed that the specific character of Ukrainian asylum seekers is in the following – they submit application in all EU countries, not in one or two. “Ukrainian community is the most diversified society, which we know. Ukrainians are worldwide”.

In its turn, the representative of European Office on Asulym Seekers Support, Timoty Cooper declared that Ukrainians most often choose such countries as Italy, Germany, France and Spain.

It is worth to mention that for the present moment Ukrainians make up 3% of total number of asylum seekers in EU countries. They are followed by the Russians (2%).

The citizen of Syria arrived from Istanbul to Kyiv. Traveling en-route to Stockholm the man intended to cross the border in illegal way as he presented a passport of the citizen of Spain for the check, which was completely false. As it was established soon, the detainee paid €1000 for it. The border guards of Separate check point “Kyiv” detected the forgery and returned the violator by the back flight to the country of departure.

In the frames of operation on counteraction to illegal migration Chop border guards detained a group of unfamiliar persons intending cross the border and to get to Slovakia in illegal way. Nine persons of Asian appearance were detected and detained by the border guards while patrolling the area of BS “Velykyi Bereznyi”. In a result, during the locality investigation with assistance of the service dog, the border guards detained two more unknown persons. As of one the detainees explained, all of them are the family, migrants from Afghanistan, however, no any documents they had. There were five adults and 6 minors in the family, of them three children of the age 7 years. According to the words of the detainees they paid the unfamiliar persons $20000 for the trip. Yet, the smugglers had to get $30000 after the family would reach Slovakia.

State Border Guard Service of Ukraine, being a law enforcement body of special designation since 2003, pays a great attention to issues on fight against the organized criminality at the state border. According to the determined authorities by the effective legislation, the subdivision of Border Guard Department in cooperation with other competent bodies constantly perform the complex of actions in the sphere of counteraction to trans-border criminality, conduct reconnaissance, informational and analytical, operative and searching activity, take part in the events directed upon the fight against the organized delinquency and resist illegal migration in the interest of state border protection provision. It is worth to mark that only in the year 2015 the operational subdivisions of State Border Guard Service disclosed 23 channels of illegal migration and established the complicity of 68 persons in the unlawful activity.

Besides, there were 8 channels of illegal migration liquidated in a result of conducted coordinated actions in cooperation with other law enforcement agents, conducted in Transcarpathian, Kharkiv, Vinnytsya and Odessa regions (5 channels on transportation of citizens of Afghanistan and 3 – citizens of Syria). The organizers of unlawful activity were apprehended, of them there were 12 citizens of Ukraine and 3 from Syria, who directly formed and carried out the transportation of the groups of illegal migrants to Transcarapathia for further transfer to the countries of European Union. So far, the pretrial investigation is performed in the frames of 33 criminal proceedings as to the Article 332 of Crime Code of Ukraine (illegal transportation of persons through the state border of Ukraine).

Also, since the beginning of the year there were 6 citizens of Ukraine and 2 citizens of Poland detained for organization of 5 channels of human traffic in Zhytomyr, Kyiv, Volyn and Kherrson regions.

Border guards of Separate check point “Kyiv” detained 37-year-old man arrived from Istanbul in the airport “Boryspil”. The citizens of Pakistan showed the completely forged identification card of the citizen of Cyprus. The false ID-card was bought by detainee’s mother for 2000€ residing permanently in Prague. Also she paid the tickets of her son from Istanbul to Prague with the change in Kyiv, where the traveler was apprehended. So far, the person is sent back by a return flight to Turkey.

In the next two years Czech Republic shall be obliged to accept at least 1300 refugees from Syria and Eritrea. European Commission has made a statement on such a proposal. Under the concept of European Commission, the countries being the EU members will accept 40 000 refuges in the course of two years.

The Czech quota is minimally 1328 persons. Acceptance, holding, “pocket money” to each of the migrant will cost the country € 6000 at least estimate. Also, European Commission has proposed a quota on refugees and persons appealing for political asylum from other countries. Czech Republic “got” 525 persons. The government of Czech Republic opposes this number of refugees and regards that they have to be assisted at “the place of their residence”, however in according with the EU standards Czech Republic cannot repudiate the unified rules if they will cover the entire European Union.

The Vice-Minister Andrey Babysh supposes that Czech Republic better accepts Ukrainians rather that the citizens of Syria and Eritrea.

The direction of the Czech government immediately reacted upon the proposal of European Commission as to the quotas for the refugees.

The Prime Minister Boguslav Sobotka reported: “We do not agree with the system of the obligatory quotas. We shall make decisions ourselves – whom to accept on the territory of the country, who will get assistance considering the social and economic aspects as well as issues of state security.”

The Vice-Minister and Minister of Finances Andrey Babysh, in his turn, regards that Czech Republic shall provide aid to Slavic nations, namely to the citizens of Ukraine appearing in crisis situation. “We are Slavic, if Czech Republic has the problem with labor force, so we shall establish the migration policy considering the people assimilation”, – Babysh mentioned.

Border guards of Separate check point “Kyiv” in the airport “Boryspil” detained a person with forged Italian passport. Among the flow of the passengers arrived from Tegeran, border guards detected 33-year-old man while he was presenting his passport of the citizen of Italy for the passport control, which contained the signs of the forgery. However, the passenger insisted on the validity of the Italian passport. Later on, in the course of the interview the man confessed that he was the citizen of Iran. The forged passport was sent by his father residing permanently in Italy. Soon, the violator will be returned by back fly.

One more citizen of Iran was apprehended by the border guards of BS “Shegeni” , Mostytskyi Detachment 200 m before the border . Having no visa to the neighbouring country, the man decided to avoid the check point. By the court decision he was fined for the sum of 2 500 UAH. Besides, this citizen is banned to enter Ukraine for the terms of 3 years.

The Public Prosecutor’s Office in Transcarpathian region registered a criminal case on the fact of abuse of power by the officials of Mukachevo Border Detachment (Part 1 Article 365 of Crime Code of Ukraine).

It is said about illegal detention of the citizen of Palestine Attalakh T. by the border guards.

The Public Prosecutor’s Office conducted the corresponding verification establishing:

– the officers of Mukachevo Detachment abusing their service powers having no sufficient legal basis and without drawing up the protocol on administrative apprehension, leaving the Transcarpathian Regional Centre on providing with the secondary assistance, detained Attalakh T. in order to prepare protocol for committed administrative infringement, which was returned by the authoritative body as it lacked the corpus delicti.

The next group of “happiness seekers”  was detained by the border guards of BS “Velykyi Bereznyi” in the course of the procedures on counteraction to illegal migration. Information about appearance of unfamiliar persons in the border area was received beforehand. In a result of conducted events, five persons, introducing themselves as the citizens of Iran, were stopped in the suburb of the district centre 1,5 km before the border on Slovakia. They aimed to get to the countries of European Union.

Detainees were delivered to Border Subdivision to establish the circumstances of the infringement and prepare administrative and procedural documents. Their further destiny will be defined by the court.

State Border Guard Service pays great attention to the issues on counteraction at the state border, besides to illegal migration. It is worth to mention that in cooperation with other law enforcement agents and Migration Service the joint actions are constantly undertaken, due to which it was sufficiently managed to limit fundamentally the flow of illegal migrants to EU countries.  However, the problem is still acute.

It is especially urgent for the western area of the border. Attempts to smuggle illegal migrants aboard in the area of the Western Regional Department are mainly carried out by the malefactors in the Hungarian and Slovakian areas of the state border. In total, since the beginning of the year, almost 397 illegal migrants intending to get to the neighbouring countries in illegal way used “green areas” of the border and forged documents in the check point.

A sufficient increase in the cases of unlawful activity is observed in the current year connected with the illegal transportation of persons at the Hungarian area of the border. Attempts of violation were fixed in the areas of BS “Salovka”, “Kosyno”, “Goronglab”, “Vylok” and “Luzhanka”. Thus, for example, recently the border guards of BS “Kosyno” of Mukachevo Detachment noticed and detained 5 trespassers by means of the thermal imager, who intended to get to Hungary beyond the check point in illegal way.

The principle delivery channels of “lasting traveler” go through the Serednyoveretskyi mountain pass by transit over the populated areas of Transcarpathian region. So, the violators apply different tricks during the illegal trip. Besides, they specially use the equipped secret places in the minibuses or lorries (screens, double walls or roofs, etc.) intending to avoid the check point on floor by means of GPS navigator.

The representatives of such countries as Africa and the Near East are in the majority of the illegal migrants.

It is worth to mention that due to successfully performed complex actions by the law enforcement agents as to liquidation of the Somali channel, its activity has sufficiently decreased in comparison with the previous years. In general, the border guards detected a great number of illegal migrants to the border by automobile, railway transport as well.
