Ukraine is important transit country for migration to Europe. The specialists of organization “Doctors of the World” transferred the system of ultrasound diagnostics Acuson X150 to its partners inUkraine– Charity Organization “Medical Aid Committee in Zakarpattya” that renders medical aid and psychological support to refugees and asylum seekers in Transcarpathia including women who became the victims of human traffic. The majority of persons in need of undergoing ultrasound diagnostics are pregnant women who more often address for such aid.

Nowadays,Ukraine is on the fourth place as to the number of migrants after the USA,Russia and Germany. According to UNO calculations, there are about 6,7 million illegal migrants in Ukraine, who use the country as transit point on the way to the countries of European Union. In the course of the last ten years, the flow of illegal migrants has grown almost in 20 times. Since2005, a stable tendency has been observed as to increase of the flow of migrants above the number of those who wish to leave the country. There are about 200 000 migrants registered live at Temporary Holding Facilities, who pend to get asylum or right for stay in Ukraine.

Nine illegal migrants from Afghanistan and Somalia were apprehended at the border

During some days Transcarpathian border guards detained 9 illegal migrants from Asia and Africa.

On the eve of the weekends, border guards of Mukachevo Detachment together with police officers detected and detained 5 citizens of Afghanistan. The group of illegal migrants, 4 men and a woman of the age 16 to 26 years old were noticed in the suburb of the village Dyida, Berehovo district. One of the detainees knew Russian language. He explained that illegal migrants intended to get to the countries of Western Europe. He also informed that they were brought by unfamiliar persons by car and left in the forest area. They took their mobile phones and documents. At present moment the checking measures are carried out in order to detect persons involved to present violation.

Besides, yesterday border guards of BS “Knyagynya” of Chop Detachment detained 4 citizens of Somalia due to preliminary information received from local inhabitants. There were 3 minors among the frozen Somalis.

Special mission of Volyn deputies and journalists is going to visit rebellious Somalis

The last events around Temporary Accommodation Centre (TAC) in Zhuravychi gave rise to loud discussion of the problem in social network Facebook. It seems that a special mission of deputies and journalist is going to visit TAC in Volyn. Finally, bloggers out of number of deputies and journalist acquainted with the situation directly at the place. It became know from the discussions in the social network.

Local politologist and journalist Ruslan Tymoschuk, who initiated the discussion of the problem, regards that such centres should not be in Ukraine, as the part of their residents persistently aim to stay here for permanent residence.

“Take notice of the fact that the part of centre’s resident has already asked to stay in Ukraine. I know for sure that these persons are not qualified doctors, workers or engineers. What for will they live here?..” – Tymoschuk asks.

The deputy if Volyn Council Igor Guz found out that the trip to TAC is ready to start, which became the place of unforeseen situations of different kind during the last period.  Interest to the problem and readiness to assist in its solution was marked by another deputy of Regional Council and journalist of “Volyn-nova” Oleksandr Pyrozhyk. He thinks that the problem has already appeared in the time of “orange revolution” when its members were in power in the region and the centre in Zhuravychi was in the process of its building. According to the words of journalist and deputy, now we have enough of it. Other journalists of leading Volyn editions also offered to join the trip to Zhuravychi. Thus, it is evident, that in the course of the nearest time the problem will go beyond the Departments and organizations taking care of TAC till present time.

UNO will check how Ukraine holds refugees

The United Nations High Commissioner for Refugees (UNHCR) is concerned about the situation with refugees, who are at TAC in Volyn and Chernigiv regions. It was announced at Regional Representation of UNHCR in Belarus, Moldova and Ukraine.
«Situation leaves to be problematic regardless of several visits of UNHCR staff and officials. Aiming at clearing out the situation, there are some planned additional visits next week, which will include the communication with detainees», – it is said in the statement.
According to information of Representation, there are more than 100 persons protesting against their detention and affirm that they are refused in opportunity to exercise the right to submit application on refugee status granting.
«Some persons are sentenced to one year of imprisonment for the attempt to cross the state border without proper documents, they protest against freedom limitation, they threaten to resort more determined forms of protest. Some of them assert that they are minors without accompaniment, migrants from Somalia, who in accordance with international and Ukrainian standards deserve special attention”, – it was reported in Representation.
At present moment, UNHCR is not able to check all information, which office goes on receiving. “It becomes unclear why so many persons telling that they are minors and are supposed to be adults by the authorities, as Ministry of Health Care has just recently started elaboration of the procedure on age evaluation. The determination of the real age and sometimes personality identification is rather complicated task in any situation. Thus, UNHCR expresses its readiness to assist authorities in solution of present problems with the help of the most admissible way”, – it is said in the statement.
According to existing information in UNHCR, there are some Afghan families with children in TAC “Volynskyi”. “It means that children of school age are left without access to education during six months”, – the Representation of NHCR marks.
UNHCR also expressed special disturbance concerning the last information received on January 30 about the action of police as to detainees in TAC.
«UNHCR checks various statements already received as well as expects information from two members of Commission on Torture Prevention and staff of State Migration Service that today are in the process of investigating at the place and must communicate with detainees”, – it is reported in the statement.

Somalis released by police were found by human rights activists behind the closed door (photos+video)

Somalis being recently detained by police affirm that they were demanded $2000. They were closed by force in the flat. After some calls to human rights activists and help of Security Service illegal migrants were released.

– Dek closed us here. This foreigner works with police, – translator translates Somalis. – Yesterday we gave him $300 to be released. We said to ask more money from relatives and friends. On this purpose, they left us phones.

Somalis tell that they were taken to the flat and closed there after a talk with police officers. Since Wednesday (January 1) they did not have anything to eat and one of the girls felt bad. Boys called to Svitlana Poberezhets – human rights activist. She communicated with them overnight in the presence of police officers.
– According to their words after detention by police in the flat on the Kotsjubynskyi Str. and interrogation in the department, they were taken to another flat and were kept there by force, – the representative of Centre on Aid to Refugees, human rights activist, Svitlana Poberezhets says. They asked passerby from the balcony to tell the address and in such a way they learned the place of their detention. First, I phoned to police, then to Security Service and public prosecutor’s office. I was ignored by all of them.

«We want to have refugee status»
After three hours of Svitlana and her colleagues’ waiting at the door, the representative of Security Service arrived. Later on, they came back with that very Dek, who opened the flat by his own key.

– They live here, they were detained yesterday and released,- Dek says. – They have all necessary things, water and food. Nobody keeps them here.

However, Somalis affirmed to journalists for camera through a translator that they were kept by force.

-They say, that police officers demanded money for their release, – S.Poberezhets says translating the answers of Somalis from English. – We want peace and get refugee status in Ukraine, we want to apply our documents. We got to Ukriane through unmarked borders with Russia, and there we arrived from Somalia escaping from danger. We addressed for help to International Commissar on Refugee Issues. Yesterday, after we were in police station, Dek and two men in uniform took us to this flat and closed the door. We think, they want money from us. $300 were already paid to Dek yesterday.

Police participation will be checked by Security Service of Ukraine (SSU) 
The age of all those who were in the flat was under 18 years old – these were five boys and two girls. One of Somali girls felt really bad. Ambulance was called for her and two other boys. While the doctors were coming, the girl was recovered consciousness.

– Their friend lost consciousness. She says that she is out of strength at all. There are pains in the heart and stomach. Doctors from ambulance hospitalize them.

As it was explained by the human rights activists, SSU had to interrogate S.Poberezhets. If she names the concrete persons, so they must establish the participation of these persons, interrogate them and make decision in accordance with the application.
The head of Vinnytsya Municipal Administration of Interior Yuriy Kutsyi categorically denied the participation of police to detention of illegal migrants at the flat. He said that seven minors were detained recently, on February 1.
– Number “102” has received a call from the citizens, who informed about possible escape of gas in the flat on Kotsjubynskyi Str. The police officers came and detected foreign citizens without documents in the flat documenting the fact. Migration Service has to take care of them because detainees are under age persons.

He also reported that police does not have translators. So to say, a person placing illegal migrants to another flat does not have anything in common with police.

–         It is nonsense, – he said about the statement of human rights activist about demanding of money.

Human Rights Watch accuses Ukrainian police in beating detained illegal migrants from Somalia

International Human Rights Organization Human Rights Watch accuses law enforcement agencies in a rough use of force to detained citizens of Somalia for illegal stay in Ukraine, who are at the Temporary Accommodation Centre “Zhuravychi” (Volyn region).
According to information presented on the site of the organization, 58 detained Somalis have gone on hunger strike in token of protest against destitution of opportunity to apply for asylum and against unjust consideration of their applications by Ukrainian authorities.
“As one of the hunger strikers reported to HRW, on January 30 in the afternoon a group of about 21 policemen in masks arrived  to TAC having truncheons and tear gas. They searched the rooms of detainees and confiscated some personal things… The same man informed us that policemen beat some hunger strikers with truncheons and feet”, – it was said on the site.
Somalis also appeal to release them, as in case of their deportation to the country of their origin where they can undergo the risk of tortures and prohibited treatment, Ukraine will violate its international obligations.
In its statement, Human Rights Watch appeals Ukrainian authorities not to let such incidents and immediately to stop oppressions and threats from police concerning migrants from Somalia seeking asylum in the TAC Zhuravychi.
It is not the first accusation is sounded in the address of Ukrainian law enforcement agents. Before Amnesty International  criticized Ukrainian law enforcement agents accusing them in rough treatment of citizens of Somalia and Eritrea, who were detained for illegal stay in Ukraine.

Amnesty International has criticized Ukrainian police for the treatment of refugees

It was said in the statement on the site of the organization. According to data of organization, there are about 60 Somalis and 6 citizens from Eritrea including 20 children, who were detained on the territory of Ukraine in November-December 2011 and were placed to Temporary Accommodation Centre in Zhyravychi, Volyn region. Detainees went on hunger strike as a protest against imprisonment. On January 30, the law enforcement agents being armed with truncheons and worn in protecting outfit forced illegal migrants to eat food. According to data of Amnesty International they were beaten and some of them received anonymous e-mails and phone calls containing threats on murder and racist offences. Amnesty International calls Ukrainian authorities to guarantee safety to illegal migrants. “Authorities must guarantee the absence of tortures and other kinds of cruel treatment of these detained persons…These migrants seeking asylum just try to avoid the breach of human rights in the countries of their origin and now they undergo cruel treatment in Europe”, – it is marked by the deputy director of Amnesty International on European Countries and central Asia, John Dalhusen. The organization notes that Ukraine joined UNO Refugee Status Convention and cannot deport citizens to the countries, where they can be subjected to risk of serious violations of human rights. In accordance with this fact, Dalhusen regards that detention of persons does not have any juridical grounds. As it was mentioned in the statement of UNHCR, it appeals Ukrainian authorities to grant refugee status or complementary protection to citizens of Somalia, who were arrested by police in December 2011 for illegal stay in Ukraine. On January 19, International Human Right Organization Amnesty International called Ukrainian authorities to release Somalis, who were apprehended by police in December 2011 for illegal stay in Ukraine.

Ukraine: Stop Harassing Somali Asylum Seekers

Hunger Strike Highlights Flaws in Asylum System

(Moscow, February 1, 2012) – The Ukrainian authorities should immediately stop police harassment and threats against Somali asylum seekers held at the Zhuravychi Migrant Accommodation Centre, Human Rights Watch said today. In a letter sent to the Ukrainian authorities, Human Rights Watch also called for the immediate release of all Somali asylum seekers who are being held in administrative detention pending deportation.

According to information from representatives of the UN High Commissioner for Refugees (UNHCR) in Ukraine, 125 Somali nationals are being held at the Zhuravychi Migrant Accommodation Centre (MAC) in the Volyn region in northwestern Ukraine. Around 80 have told UNHCR they want to apply for asylum in Ukraine, but have not been allowed to do so, and some have been on hunger strike in response.

“Somali nationals who flee from violence and persecution in their own country are already extremely vulnerable,” said Hugh Williamson, Europe and Central Asia director at Human Rights Watch.  “They come to Ukraine seeking protection. The Ukrainian authorities know they can’t deport Somalis, so keeping them locked up for months, with almost no chance of asylum, is extremely abusive.”

Fifty-eight Somali detainees went on hunger strike in early January to protest against the Ukrainian authorities having prevented them from lodging asylum claims or not having processed their claims fairly. They are also protesting against their arbitrary detention; since Ukraine cannot, without violating its international obligations, deport them back to Somalia where they would risk torture and mistreatment, their detention pending deportation is arbitrary.

The Somalis are among tens of thousands of asylum seekers and migrants in Ukraine, many of whom are attempting to eventually cross the border to the European Union.

On January 30, the situation at the Zhuravychi MAC deteriorated. One of the hunger strikers held at the center told Human Rights Watch that in the afternoon a group of approximately 21 police officers, masked and armed with batons and tear gas, came to the center. The police officers searched detainees’ rooms and confiscated some of their personal belongings.

He also told Human Rights Watch that the police officers hit some of the hunger strikers with batons and kicked them:

“They beat some of the boys and kicked them with heavy boots. They were shouting the whole time, but we could not understand them because they spoke Russian.  Only two guys in our group speak Russian so they translated for us. The police officers were threatening to kill us if we don’t go to the dining room and start eating. About 10 people got so scared that they ran to the dining hall and started eating. The police are still around today and we are all very scared.”

Ill-treatment of any detainees is strictly prohibited and a violation of Ukraine’s international legal obligations. To target detainees who choose to manifest their right to protest by way of a hunger strike is also prohibited, and the Ukrainian authorities have previously been found responsible for torture under European human rights law by forcibly feeding detainees in the absence of any medical necessity (in the case of Nevmerzhitsky v Ukraine). Human Rights Watch called on the Ukrainian authorities to investigate the police conduct at the center on January 30 and to hold to account anyone involved in and responsibile for abusing and threatening the detainees.

A Human Rights Watch report from December, 2010, “Buffeted in the Borderland: The Treatment of Migrants and Asylum Seekers in Ukraine”,documented that migration detention in Ukraine is often arbitrary and detainees do not enjoy reliable access to a judge or other authority, or access to legal representation to challenge their detention. The report also documented how asylum applications from detainees are frequently not processed, how many claims are rejected as manifestly unfounded, and how a migrant or asylum seeker may be detained without any individual assessment of such necessity.

Somali nationals are very rarely granted asylum status in Ukraine (when the Human Rights Watch report was released in 2010, only two Somalis were known to have been granted refugee status.) And they appear to face a vicious cycle of repeat detention while in Ukraine.

Ukrainian law provides that migrants and asylum seekers may only be detained for a maximum of 12 months. However, the law does not prohibit the authorities from re-arresting migrants as soon as they have been released and detaining them again for the maximum period allowed. When released, migrants are usually provided with certificates saying that they are on their way to their embassy and are given five days to reach it. However, since there is no Somali embassy in Ukraine, Somalis have nowhere to go. It is a common practice for Somali migrants to be re-arrested after the five days have expired and detained again.

Human Rights Watch spoke with three members of the group of hunger strikers who are being held at the Zhuravychi MAC. They said the majority of the group had been repeatedly arrested and detained over the past year or more. They also said that some members of the group were at different stages of appealing rejections of their asylum applications by the State Migration Service. Others had been detained before they had been allowed to lodge their appeals or said that no action had been taken on claims filed while in detention, leading them to believe that the authorities had not actually accepted their applications for asylum or their appeals.

A 21-year-old Somali detainee told Human Rights Watch that he wanted to appeal the State Migration Service’s rejection of his asylum application as manifestly unfounded or abusive, but that days later the police arrested and detained him on suspicion of being unlawfully in Ukraine, and that he was not able to appeal the rejection of his claim. He was then transferred to the Zhuravychi MAC for a 12-month administrative detention sentence.

“We came here to save our lives, not be treated like criminals” he told Human Rights Watch. “There is a war in my country. But here we have no medical assistance, we can’t rent a flat, we can’t even go outside because we get arrested. We escaped from one prison only to come to another one.”

In the letter sent to the Ukrainian authorities, Human Rights Watch called for the immediate release of all Somali asylum seekers who are being held in administrative detention pending deportation and urged the government to utilize a new law on complementary protection by providing this protection to Somalis who do not qualify for asylum under the 1951 Refugee Convention but who cannot be returned to Somalia because of ongoing armed conflict and generalized violence in that country.

“Ukrainian authorities should do what they can to improve the country’s flawed asylum system and close existing gaps in protection,” Williamson said. “Taking immediate steps to stop abuse in detention and facilitate adequate solutions for Somali migrants, asylum seekers and refugees would be a step in the right direction.”

Meeting of the head of SMS of Ukraine with Regional Represenative of UNHCR took place

On February 1, 2012 the head of State Migration Service of Ukraine Mykola Kovalchuk conducted the meeting with representative of UNHCR Oldrih Andrisek.

The main topic of the meeting was discussion of the generally recognized world standards of holding foreigners, who pretend to get refugee status and also improvement of the procedure of submission of corresponding applications in Ukraine.

The parties also discussed separately the situation happened at Temporary Holding Facility “Volynskyi” for foreigners and stateless persons, who illegally stay inUkraine. They also exchnaged opinions on ways of normalization the situation and peculiarities in treating asylum seekers of Somali origin. In the course of the meeting the head of SMS of Ukraine stressed that all persons kept at THF have equal rights regardless of the country of their origin.

Besides, in their communication, Mykola Kovalchuk and Oldrih Andrysek stopped on the concrete aspects of cooperation and defined the priorities on short-term perspectives.

There were also other participants of the meeting: the first head deputy of SMS Viktor Sheibut and director of Refugee Department Nataliya Naumenko.

International scandal over the article in a local newspapers: Is Ukraine a country of racists and xenophobes?

Ukraine is the country of xenophobes and racists. World press published such conclusions. All has started from the article and illustrations to it in Ternopil newspaper. Local journalists so got carried by the reporting of the fight between two foreign students because of Ukrainian girl, so they did not notice that used improper words in the address of migrants from African and Arab countries, it is reported by TSN (Ukrainian TV news programme).

Newspaper material illustrated the pictures of Africans who had rest in the pub. And in the foreground there was a collage – two monkeys are touching up a blonde girl.

Student from Congo Moug Danik Brysche was one of the men on the picture. He recognized himself in the newspaper and was filled with indignation how that picture got to the press. Future engineer-mechanic Mouga does not know yet whether he should pack suitcases or take a cap hiding himself in order to continue education. He affirmed that he did not participate in the fight described in the newspaper, but now he is very recognizable in the city and is called “monkey”.

«Here you can be beaten every day, – Mouga tells,-  there are many racists here». Two hundred students  of Ternopil University demand excuses from local newspaper. Allegedly, they offended African students and Arabs very much.

«This newspaper wrote that we are black monkeys…– it is said by the student from Cameroon Martin Landro Maien. – We want them to present their apologies, we want them to see us as human beings and not as animals».

Scandal over the article in Ternopil newspaper was caught up by the world Mass Media. The channel “France 24”picked up the button from the channel “CNN”. On its internet-portal, it put the article “Ukrainian newspaper represent Africans and Arabs as monkeys, who touching up the woman”.  After such publicity, students say that their relatives ask them to return home as soon as possible.

«He has to come back home because his father has read an article at “France 24” and said “Fly home at once”, – Martin, the student from Cameron said. – “He is on the fifth year of Medical University, he leaves everything and goes back home”.

The print “New Ternopil newspapaer”, which published an article causing sensation, regards to be the most scandalous one in the city. True, there is no any name of the author. Local journalists are talking of the article to be written by the editor-in-chief. Though, he and his staff refuse to give comments on it. The public prosecutor’s office tackled to find out whether publication rouses national hatred.

«The check is connected with just this publication and in no way with the previous ones, thus, we cannot tell that some pressure is carried upon Mass Media”, – it is assured by the pres-secretary of prosecutor of Ternopil region, Lesya Dolyshnaya.

The investigation is still going on. The board of Ternopil University because of the scandal tries not to loose foreign students – sponsors of the establishment. In order to reconcile offended persons the lectures are conducted and appeal with demand to make apologies for incorrect statements has already been written.

It was reported before that Ukrainian police as well as the society overall is affected by race and ethnic intolerance to a considerable extent. It is said in the statement of Ukrainian Refugee Council.

It was also reported that the activity of youth informal associations has started to grow in Ukraine since 2005, the activity of which is directed upon the violent actions based on race and national hostility. According to investigation data “Racism and xenophobia in Ukraine”, the violence is more often directed against foreign students, asylum seekers, refugees and migrants, businessmen and tourists. The victims became also some workers of the embassies, UNO representatives as well as the members of their families.
